Verizon Wireless “Get It Now” Mystery Fee Class Action
By Sarah Pierce

Verizon WirelessVerizon Wireless has been slapped with another class action lawsuit for improperly billing customers for “unidentified, unwarranted and recurring” fees.

According to the Verizon Wireless class action lawsuit, Verizon improperly charges consumers $9.99 a month for its “Get It Now” download service. These charges appear on monthly bills under headings including “Get It Now,” “Get It Now Downloads” and “Data Usage Charges” without explaining which subscription it is referring to or identifying the purported download.

Verizon Wireless is no stranger to improper billing practices. The telecommunications giant agreed to pay up to $90 million in refunds last year to 15 million wireless customers to settle a federal investigation of “mystery fees” it charged for accidental Web access and data usage. The Federal Communications Commission estimated Verizon Wireless had overcharged customers by more than $50 million in the past several years by tacking on these improper “mystery fees.”

As part of the FCC Verizon mystery fee settlement, Verizon agreed to establish a “Data Charge Task Force” to resolve data charge complaints and ensure that customer service employees are aware of any widespread data billing issues. It also agreed to provide its customers with easy-to-understand information about data charges through bill inserts, welcome letters, online bill messages and an online bill tutorial.

This never happened, says the new Verizon billing class action.

“[Verizon Wireless] intentionally instituted billing and customer service practices designed to prevent customers from understanding what they are being charged for and avoiding such charges,” the class action states, adding that customer who have repeatedly asked to cancel the purported “Get It Now” service and demanded refunds have been ignored.

The Verizon Get It Now class action lawsuit is charging Verizon Wireless with violating several laws and regulations, including the FCC Truth-In-Billing Act, which states “charges contained on phone bills must be accompanied by a brief, clear and non-misleading description of the service or services rendered.” It is seeking refunds and damages for a propped class of all affected consumers in the U.S.

    Add if I am.

I have been looking into all my bills from March 2012 onward and I have determined that I was billed $9.99 per month through June 2012 and then it was reduced to $1.99 per month since then.
I doubt that I will ever see those dollars again so I terminated Verizon early and moved to T-Mobile. Net-net I am ahead of the game and very happy with the service that I am receiving.

my daughter’s phone had a mysterious scrabble game show up. I noticed the charge right away, and called to take care of it (since she hates that game and would never download it on purpose.) We blocked her internet and they “took care of” my bill. With her internet blocked, and unlimited text and talk, I never thought about it again. UNTIL, I changed my plan over to the share everything plan. I looked at my last bill and saw I was still getting charged 3.99 each month for something I thought was taken care of!! It was about a year and a half, and they refuse to do anything, EVEN when I called in the very beginning, which they could see notes and verified. I am so upset about this, I don’t know what to do!

I agree. I never ordered VZ Navigator because I use Google Maps, but was charged for it anyway.

I am also being charged $1.99 per month for Get It Now. I have no idea why.

I checked my Verizon bill online and I saw that I have been charged for 2 services that I never subsribed to. They have been billing me since May of 2011 for Visual Voicemail and there VZ Navigator GPS Service. I never ordered these services. I have the Droid X which already have the Google maps so I do not need another GPS Service. The Customer Service Rep said I must have ordered this and that she could only back date it and remove this service, she then said as I was upset that she could credit me only 1 month. I have heard that Verizon does this and then put the “blame” on the consumer as she said I should have noticed these charges on my bill!
