Are you being contacted about a debt you don’t owe?

The Florida Consumer Collection Practices Act (FCCPA) provides specific protections for consumers against debt collection practices, including situations where a consumer is contacted about a debt that isn’t theirs. Under the FCCPA, debt collectors are prohibited from engaging in abusive, deceptive, or unfair practices when attempting to collect a debt.

Do you qualify?

If you live in Florida and were contacted via phone call, text, email or U.S. mail within the last year for a debt you don’t owe, you may have a legal claim under the FCCPA. This includes being contacted by the original creditor or by a third-party debt collector hired by the first party to collect the debt on their behalf. If you live in another state, you may have a claim under a different law called the Fair Debt Collection Practices Act (FDCPA).

FCCPA overview: Florida debt collection laws

The FCCPA provides stronger protections than federal law when it comes to debt collection practices. This state law addresses not only communication during late hours but also various unethical tactics that some debt collectors use to intimidate individuals into making payments.

Specifically, Florida debt collection lawsprohibit debt collectors from:

  • Misrepresentation: Debt collectors cannot falsely represent the character, amount, or legal status of a debt. This means they cannot claim you owe a debt that you do not owe.
  • Harassment and abuse: Debt collectors are not allowed to harass or abuse any person in connection with the collection of a debt. This includes contacting you repeatedly or continuously, using obscene or profane language, or making threats of violence or harm.
  • Deceptive practices: Florida law specifically prohibits debt collectors from using any false, deceptive, or misleading means to collect a debt. Prohibited practices include pretending to be a law enforcement officer, government official, or attorney.
  • Disputed debts: If you have disputed a debt, in most instances a debt collector cannot report or threaten to report information about the disputed debt without also disclosing that you are disputing it.

It’s advisable to keep detailed records of all communications with debt collectors, including dates, times, the nature of the contact, and any written correspondence. If you choose to pursue legal action, this information may be helpful for your case.
