A $3.7 million settlement has been reached to resolve claims that Allstate didn’t pay for certain types of automotive damage for Washington residents.
The settlement benefits individuals who were insured by Allstate Insurance Company in Washington and received payment under their uninsured or underinsured property damage coverage between May 13, 2010 and Jan. 11, 2019. Further stipulations about Class Members are detailed in the “Who’s Eligible” section below.
Plaintiff Marc Daniel Vigna filed his class action lawsuit against Allstate in May 2016, claiming that the company failed to sufficiently pay for diminished value losses that occurred after damage to a vehicle’s structural systems and bodies.
The damage reportedly means that vehicles cannot be repaired to their pre-accident condition. However, Allstate allegedly failed to pay for this diminished value loss under its uninsured or underinsured property damage coverage stipulations in Washington.
Allstate denies that it did anything wrong or unlawful. Instead the $3,704,177 settlement will provide a resolution for all parties without the costs and risks of continuing litigation.
Under the settlement, Class Members may be able to collect several hundred dollars if they file a valid Claim Form by June 17, 2019. However, the exact payment amount will vary depending on each Class Member’s repair costs.
The deadline to object to the settlement or request to be excluded is April 3, 2019. The final approval hearing is scheduled for May 3, 2019.
Who’s Eligible
Individuals who were insured by Allstate Insurance Company in Washington and received payment under their uninsured or underinsured property damage coverage between May 13, 2010 and Jan. 11, 2019. Additionally:
- The repair estimate on your vehicle (including any supplements) totaled at least $1,000; and
- Your vehicle was no more than six years old (model year plus five years) and had less than 90,000 miles on it at the time of the accident; and
- Your vehicle suffered structural (frame) damage and/or deformed sheet metal and/or required body or paint work.
You are not a part of the Class if, at the time of your accident:
- Your vehicle was leased; or
- Your vehicle was declared a total loss; or
- Your covered accident was before May 13, 2010.
Potential Award
Varies depending on the repair costs. It is estimated that the average payment will likely be “in the range of several hundred dollars.”
Proof of Purchase
Class Members will be required to provide a Unique ID when submitting a claim. If you didn’t receive one, contact the settlement administrator at 1-877-449-1869.
