Geico total loss settlement has been reached.

GEICO has agreed to a total loss settlement to resolve allegations that they violated their contract terms by failing to include sales tax and fees in total loss payments. Under the settlement terms, Class Members could collect payments estimated around $1,300.

The settlement benefits individuals who had an auto insurance policy through GEICO Indemnity Co. or Government Employees Insurance Co., in Florida and who submitted a damage claim on a leased vehicle between June 15, 2013, and Aug. 1, 2020, that resulted in a total loss payment.

Also included in the settlement are individuals who had an auto insurance policy through GEICO General Insurance Co. in Florida and who submitted a damage claim on a leased vehicle between Aug. 30, 2011, and Aug. 1, 2020, that resulted in a total loss payment.

Plaintiffs in the GEICO total loss class action lawsuit alleged the insurance company violated its own contract terms by failing to pay out full total loss payments. Allegedly, the company failed to compensate policyholders for sales tax, title fees and other costs.

GEICO has not admitted any wrongdoing but has agreed to a total loss settlement to resolve the claims against it. The settlement allows all parties to resolve the claims while also avoiding the risks and costs of continuing to litigate the issue.

Under the total loss settlement Class Members can collect cash payments including statewide sales tax of 6% plus local tax on the adjusted value of a total loss vehicle, $79.85 for title and tag fees, and interest on the unpaid sales tax and title and tag fee award. According to the settlement website, class counsel estimates payments will be around $1,300.

In order to benefit from the total loss settlement, Class Members must file a valid claim form by Dec. 28, 2020. A Claim ID is required to submit a claim form online, but a form can be printed from the settlement website and submitted through the mail. Class Members must provide their personal information along with their GEICO policy number or the total loss claim number to validate their claim.

The deadline for exclusion and objection from the settlement is Nov. 12, 2020. The final approval hearing for the total loss settlement is scheduled for Feb. 5, 2021.

Who’s Eligible

Individuals who had an auto insurance policy through GEICO Indemnity Co. or Government Employees Insurance Co. in Florida and who submitted a damage claim on a leased vehicle between June 15, 2013, and Aug. 1, 2020, that resulted in a total loss payment.

AND

Individuals who had an auto insurance policy through GEICO General Insurance Co. in Florida and who submitted a damage claim on a leased vehicle between Aug. 30, 2011, and Aug. 1, 2020, that resulted in a total loss payment.

Potential Award

Payments of $79.85 along with other compensation.

Class Members can recover several forms of compensation including:

  • Statewide sales tax of 6% plus local tax on the adjusted value of a total loss vehicle;
  • $79.85 for title and tag fees;
  • Interest on the above items.

Payments are estimated to be around $1,300.

This is a scam, a straight theft. and everyone is on the take. the attorneys the settlement administrator, GEICO. they keep your award money. look at geico total loss class action in calif. read the comments. its a damn cabal.

    I had no idea concerning this law suit. My car was totaled and I had and still have Geico did not receive the compensation for this

      Here it is almost June 2021 and all I received was $79,95, what about the estimated $1300 for the claimants? Do we need to file a class action against the people who was supposed to pay us? This is unfair. They only received the amount because we joined the class action suit and now we are being ignored about our payments!!

    Well I emailed the settlement admin and received the message below. So I guess we shouldn’t expect any payments until mid April.

      Dee, i have also emailed this attorney and received the same generic response. i sent an additional email today asking about payment. If you really read the paragraph they are referring to, it almost seems as if they have changed the terms of the settlement. I asked the law firm to explain this paragraph as i am not an attorney. Someone needs to tell us claimants what’s going on.

    I am a member of this class action settlement. My car I owned was totaled. I did receive the check for $79.00 last year. Is there suppose to be $1300 coming from this settlement also? I see the final approval was 2/05/2021
