Geico total loss settlement has been reached.

GEICO has agreed to a total loss settlement to resolve allegations that they violated their contract terms by failing to include sales tax and fees in total loss payments. Under the settlement terms, Class Members could collect payments estimated around $1,300.

The settlement benefits individuals who had an auto insurance policy through GEICO Indemnity Co. or Government Employees Insurance Co., in Florida and who submitted a damage claim on a leased vehicle between June 15, 2013, and Aug. 1, 2020, that resulted in a total loss payment.

Also included in the settlement are individuals who had an auto insurance policy through GEICO General Insurance Co. in Florida and who submitted a damage claim on a leased vehicle between Aug. 30, 2011, and Aug. 1, 2020, that resulted in a total loss payment.

Plaintiffs in the GEICO total loss class action lawsuit alleged the insurance company violated its own contract terms by failing to pay out full total loss payments. Allegedly, the company failed to compensate policyholders for sales tax, title fees and other costs.

GEICO has not admitted any wrongdoing but has agreed to a total loss settlement to resolve the claims against it. The settlement allows all parties to resolve the claims while also avoiding the risks and costs of continuing to litigate the issue.

Under the total loss settlement Class Members can collect cash payments including statewide sales tax of 6% plus local tax on the adjusted value of a total loss vehicle, $79.85 for title and tag fees, and interest on the unpaid sales tax and title and tag fee award. According to the settlement website, class counsel estimates payments will be around $1,300.

In order to benefit from the total loss settlement, Class Members must file a valid claim form by Dec. 28, 2020. A Claim ID is required to submit a claim form online, but a form can be printed from the settlement website and submitted through the mail. Class Members must provide their personal information along with their GEICO policy number or the total loss claim number to validate their claim.

The deadline for exclusion and objection from the settlement is Nov. 12, 2020. The final approval hearing for the total loss settlement is scheduled for Feb. 5, 2021.

Who’s Eligible

Individuals who had an auto insurance policy through GEICO Indemnity Co. or Government Employees Insurance Co. in Florida and who submitted a damage claim on a leased vehicle between June 15, 2013, and Aug. 1, 2020, that resulted in a total loss payment.

AND

Individuals who had an auto insurance policy through GEICO General Insurance Co. in Florida and who submitted a damage claim on a leased vehicle between Aug. 30, 2011, and Aug. 1, 2020, that resulted in a total loss payment.

Potential Award

Payments of $79.85 along with other compensation.

Class Members can recover several forms of compensation including:

  • Statewide sales tax of 6% plus local tax on the adjusted value of a total loss vehicle;
  • $79.85 for title and tag fees;
  • Interest on the above items.

Payments are estimated to be around $1,300.

    You won’t receive the $1300. I just went thru the same thing. These same attorneys are ripping off their clients. The first initial mailing card that you received where it had a claim number already issued to you, that is where the theft of your large payment began. Without knowing it that card you received placed you in the regulatory tax fee class ONLY, at the same time keeping you from being entered into the sales tax fee class. which is the larger payment. they will tell you you didnt qualify for the sales tax, but that is a lie. They used the excuse “Geico is paying the sales tax fee award, call them” with us here in California the 19.1 million dollar total loss class action. I have been trying to get us paid too. they stole over $92,000 from the unnamed class members. these same attorneys. Annick, Scott, the whole bunch is a criminal cabal. I will not stop filing complaints and exposing the crimes of these attorneys. They are doing it across this nation in every class action. think of the money they have gotten away with stealing. Everyone needs to file complaints on all of them like I did. most are registered with multiple states to practice law and I filed in every state they are licensed. Andrew Shamis isn’t even registered in the state of California yet there is his name on our court documents in california. look up 19-cv-03768-HSG(N.D. CAL) We just went thru the same thing as you guys. you got ripped off. trust me.

    Well well well, Look who the Class Counsel is. Mr. Phillips, again. Listen to everyone expecting a big check. Its already been stolen. The Class Counsel and claims settlement administrator already stole your award. That first notice you received about the class action where you were already assigned an ID is your claim number and they put you in the regulatory fee tax ONLY. which is the small check. They didn’t make a claim form for you to submit a claim for the Sales Tax Fee, which is the large payment. they never told you you had to make a claim for it nor did they mention they were making two class payments. you have been lied to and tricked into thinking you would receive both. But you won’t. They stole everyone’s large payment for the sales tax fee. They’ll tell you you didn’t qualify, that’s a lie, they claim that geico is issuing the sales tax checks, or some will be mailed checks but its made out to the defendants(Geico) and some auto body repair shop and you’re told to send it back. that’s to be able to show fraudulent accounting records to the courts that your payment was returned, and all returned checks are on a reverter clause that was agreed on per court docs, which means all payments marked as undeliverable gets reverted back to the attorneys. THEY JUST STOLE YOUR AWARD MONEY. it just happened to me in the calif case and Jacob Phillips was the class counsel there too. We have to expose this theft because they are doing it to all class actions cases. its a crime and we need to stop this abomination. YEAH, MR PHILLIPS IM CALLING YOU OUT. and dont bother threatening me again. take me to court so i can show everyone what you are doing to people.
