Verizon managers overview:

  • Why: The plaintiffs claim that Your Wireless store managers are required to work off-the-clock unpaid hours and record breaks they do not fully take on timecards.

Three store managers for a Verizon retailer are suing their employer over allegations of unpaid overtime and off-the-clock work requirements.

Plaintiffs Jason Claudio, Leo Garrison and Tyler Perry filed a class action lawsuit against authorized Verizon retailer Your Wireless, claiming the company’s requirements for them violate labor laws.

The store managers are hourly employees who are required to report a one-hour lunch break each day even if they are not able to take a one-hour break, those working unpaid hours, according to the lawsuit.

“Managers are required to attend weekly conference calls which often last 30 minutes to an hour before their scheduled working hours,” the Verizon managers class action says. “In some cases, these calls are scheduled on some Managers’ days off, but they still must attend.”

The managers are also required to be on group text message threads and often receive calls or text messages when they are not scheduled to be working, the lawsuit claims.

Your Wireless violates Fair Labor Standards Act by not paying overtime properly, lawsuit claims

The policies of Your Wireless violate the Fair Labor Standards Act of 1938 by making the managers work hours and perform duties they are not paid to perform, the lawsuit claims.

The proposed class would include all Your Wireless hourly managers who worked at the stores within the past three years. A proposed New York class is also part of the lawsuit.

The plaintiffs are asking for the unpaid overtime and non-overtime pay, along with statutory damages in New York. The plaintiffs are also asking for attorneys’ fees, incentive awards for being the lead plaintiffs and injunctive relief against Your Wireless continuing its hourly employee wage practices.
