SCR Medical Transportation agreed to pay $1.2 million to resolve claims it failed to pay its workers minimum wage due to off-the-clock work.
The settlement benefits individuals who were employed by SCR Medical Transportation as a medical van driver since May 20, 2016, and experienced waiting in line with a mobile data terminal (MDT) device for more than 15 minutes before or after their shifts.
SCR Medical Transportation offers reliable transportation to disabled individuals in order to provide them access to friends, family, and medical services. Drivers for SCR are responsible for getting clients to their destination safely and efficiently.Â
According to a class action lawsuit, SCR regularly made its drivers work off the clock before or after their shifts. For over 15 minutes per shift, drivers allegedly had to wait in line before or after clocking in or out on the MDT devices in each van. Although SCR allocated 15 minutes per shift for this wait time when accounting for wages, drivers claim that they regularly had to wait for longer than 15 minutes — resulting in off the clock work.
By failing to fully compensate drivers for their time, SCR allegedly violated the federal Fair Labor Standards Act (FLSA), Illinois minimum wage law and Chicago’s Minimum Wage Ordinance.Â
SCR Medical Transportation hasn’t admitted any wrongdoing but agreed to resolve these allegations with a $1.2 million settlement deal.
Under the terms of the settlement, class members can collect a cash payment that varies depending on the amount of time they spent in line before or after their shifts. This time wasn’t recorded, but 20 minutes will be added to each eligible workweek to determine how much each class member is owed in back wages and overtime pay.Â
Class members who received a settlement notice through the mail may have been sent a claim form that includes their payment estimate, though no other estimates are available.
One third of each settlement payment will be treated as wages. This portion of payments will be subject to tax withholding and will result in a W-2 form. The remaining two thirds of each payment will be considered penalties and interest. These portions will result in a 1099 form and will not be subject to tax withholdings.
The deadline for exclusion and objection is Aug. 22, 2022. Individuals who exclude themselves will not be able to benefit from the settlement, but will retain their legal rights against SCR.Â
The final approval hearing for the SCR Medical Transportation settlement is scheduled for Sept. 30, 2021. Class members are not required to attend this hearing in order to receive settlement benefits.
Class members must submit a valid claim form by Aug. 22, 2022, in order to recover a settlement payment. Claimants can update their address and contact information on the settlement website to ensure their payments reach them.
