Rapid Manufacturing agreed to pay $800,000 to resolve class action claims the company violated California wage-and-hour laws by failing to pay workers properly.

The settlement benefits non-exempt California employees of Rapid Manufacturing and non-exempt employees of Affluent Staffing who were placed at Rapid Manufacturing in California between Aug. 9, 2015, and Nov. 5, 2022.

Rapid Manufacturing is a global manufacturing company with locations in California, New Hampshire, Mexico, and China. The company manufactures electronic wire and cable harnesses, electro-mechanical parts and box build assemblies.

According to a class action lawsuit, Rapid Manufacturing fails to properly pay its workers regular wages, minimum wages and overtime wages. In addition, the company allegedly fails to provide proper rest and meal breaks, accurate wage statements, expense reimbursements and other employment benefits.

Plaintiffs in the wage-and-hour class action lawsuit claim these failures violated California labor laws. California has some of the strictest labor laws in the country and imposes steep penalties on violators. The state also has a unique Private Attorneys General Act (PAGA) that allows workers to bring wage-and-hour claims on behalf of the state’s labor authority.

Rapid Manufacturing hasn’t admitted any wrongdoing but agreed to pay $800,000 to resolve these allegations.

Under the terms of the settlement, class members can receive a cash payment based on the number of workweeks they worked during the class period.

Class members who worked a higher number of workweeks will receive a larger share of the net settlement fund. Exact payments will vary.

The settlement includes a $30,000 PAGA penalty payment to the California Labor and Workforce Development Agency, 75% of which will be retained by the agency and 25% of which will contribute to settlement payments to class members who worked for Rapid Manufacturing between Aug. 9, 2018, and Nov. 5, 2020. PAGA payments will be distributed on a pro rata basis similar to the primary settlement payments described above.

The deadline for exclusion and objection is Oct. 4, 2022.

The final approval hearing for the settlement is scheduled for Nov. 4, 2022.

No claim form is required to benefit from the settlement. However, class members have until Oct. 4, 2022, to dispute their workweek calculation.
