MVP Staffing allegedly discriminated against african american applicants.

Personnel Staffing Group LLC, also known as MVP Staffing, has agreed to pay a $588,260.65 settlement to end claims that the company used discriminatory practices in its hiring through the Cicero, Illinois office.

Class Members include all those African American individuals who sought work through MPV Staffing’s Cicero, Illinois office between Dec. 6, 2012 and March 11, 2020, but who, on one or more occasions, were not given work at The Segerdahl Corp., Mercury Plastics Inc., The Penray Companies Inc., Advertising Resources Inc., Lawrence Foods Inc., or MPS Chicago Inc. d/b/a Jet Litho by MPV.

According to workers who sought employment through the staffing agency, the company would regularly discriminate against African American workers, particularly men of color, by either not assigning them work at all or assigning them to work at the most difficult assignments.

The MVP Staffing racial discrimination class action lawsuit was filed in December 2016 by a group of African American men who say that they worked with MVP to find employment, but were subjected to discriminatory practices.

Allegedly, several of MVP’s clients had also participated in discrimination by requesting that the staffing agency not assign them African American workers. The workers say that the companies would use code words to indicate their racist preferences for workers. According to the MVP Staffing class action lawsuit, the staffing agency complied with these requests.

To support their assertions that the racist policies were a common part of MVP’s work practices, the workers who filed the claims stated that workers who did not adhere to requests to not send African American men were punished.

According to the MPV Staffing racism class action lawsuit, African American men were often not given work or, if they were given work, they were given very brief employment stints or ones that were extremely difficult.

Additionally, the staffing agency racist hiring class action lawsuit argues that African American men were subjected to background checks, while other workers were not.

MVP Staffing is joined by several of its clients in settling the racial discrimination claims. These clients include The Segerdahl Corp., Mercury Plastics, Inc., The Penray Companies Inc., Advertising Resources Inc., Lawrence Foods Inc., and MPS Chicago Inc. d/b/a Jet Litho.

MVP Staffing and its clients do not admit any wrongdoing in the racial discrimination class action lawsuit, but have agreed to come to a settlement with workers in order to avoid incurring additional costs and risks in continuing to litigate.

Class Members are eligible for a proportional amount of the settlement. The amount of compensation that a Class Members is eligible to receive will depend on the number of benefits claims filed. 

The settlement website explains that 50 percent of each Class Member’s settlement payment will be considered wages and will be reported as wages for tax purposes. The other 50 percent will be reported as compensatory damages for tax purposes. As a result, the settlement may be taxable. 

To receive settlement benefits, Class Members must print out and mail a claim form by June 23, 2020. Class Members who claim benefits or do nothing will waive their rights to pursue independent litigation against MVP Staffing and its clients over this issue.

Class Members do have the right to opt out of the settlement class. Class Members who do so will not receive benefits, but will retain their right to pursue independent litigation against the companies. Class Members must opt out by mail by June 23, 2020. 

Class Members are invited but not required to attend a fairness hearing for the settlement, scheduled for Aug. 3, 2020.

Who’s Eligible
