Macy’s, Bloomingdale’s labor-law class action lawsuit overview:
- Who: Ha Nguyen, Alex Bhagatram, Alicia Taylor, Soraya Lodin, Teyani Cisneros, and Michael Webster filed a class action lawsuit against Bloomingdale’s LLC and Macy’s Inc.
- Why: Nguyen, Bhagatram, Taylor, Lodin, Cisneros, and Webster claim Macy’s and Bloomingdale’s fail to pay their hourly, non-exempt workers for all their hours worked.
- Where: The class action lawsuit was filed in California federal court.
Macy’s and Bloomingdale’s regularly fail to pay their store employees for all of their hours worked, a new class action lawsuit alleges.
Plaintiffs Ha Nguyen, Alex Bhagatram, Alicia Taylor, Soraya Lodin, Teyani Cisneros, and Michael Webster claim Macy’s and Bloomingdale’s regularly require workers to perform “uncompensated and unrecorded work outside of scheduled shifts.”
Nguyen, Bhagatram, Taylor, Lodin, Cisneros, and Webster — all current or former hourly, non-exempt employees of Macy’s or Bloomingdale’s — argue the companies also expect their workers to “constantly be on call” to service any needs of “current or potential customers.”
“At the same time, Defendants refuse to record this time as worked, and refuse to compensate Plaintiffs and Class and Collective members earned wages at all for this work,” the Macy’s and Bloomingdale’s class action alleges.
Nguyen, Bhagatram, Taylor, Lodin, Cisneros, and Webster want to represent a California class of all current and former employees of Macy’s or Bloomingdale’s from the four years prior to the filing of the complaint.
Macy’s, Bloomingdale’s employees required to work ‘numerous uncompensated hours,’ says class action
Macy’s and Bloomingdale’s require their employees to work “numerous uncompensated hours off-the-clock every week” while calling or texting customers, supervisors, or coworkers, or when attending online conferences and/or training, the Macy’s and Bloomingdale’s class action alleges.
Nguyen, Bhagatram, Taylor, Lodin, Cisneros, and Webster argue Macy’s and Bloomingdale’s also regularly require their employees to work during designated meal and rest periods.
Macy’s and Bloomingdales are accused of violating the Fair Labor Standards Act along with numerous California labor codes regarding minimum wage and overtime pay, among other things.
Plaintiffs are demanding a jury trial and requesting declaratory and injunctive relief along with an award of compensatory and actual damages for themselves and all class members.
A similar class action lawsuit was recently filed against Rare Hospitality International Inc. by an individual arguing the company underpaid employees at its LongHorn Steakhouse restaurants who were paid by a hybrid sub-minimum wage and tips scale.

How do I join this suit? I also work for macy’s.
I worked for Macys I was terminated wrongfully, my hand and wrist my arm and neck from lifting and attaching security (KEVLAR)covers approximately 58 + a day five days a week . During Covid it was 92 a day they weighed est. 25lbs + each . This company doesn’t want acknowledge that this equipment exists. This was not on my job description or documented as part of the job . No training , no video ,or safety support for hands .
