H&R Block Seasonal Employee Class Action Settlement

H&R Block has agreed to pay up to $35 million to settle a class action wage lawsuit accusing the tax preparation company of failing to pay its seasonal employees in California on a timely basis, in violation of state law.
The H&R Block wage settlement will resolve a class action lawsuit, entitled Lemus, et al. v. H&R Block Enterprises, LLC, that alleges in each tax season between 2006 and 2011, H&R Block failed to pay final hourly wages and end-of-season additional compensation on a timely basis to Seasonal Tax Professionals in violation of California’s Labor Code, and further failed to provide them accurate wage statements.
H&R Block denies the allegations, but has agreed to pay up to $35 million to resolve the litigation.
Class Members of the H&R Block employee class action settlement include all individuals employed by H&R Block in California from June 9, 2006 through May 15, 2011 as seasonal, non-exempt Tax Professionals. The class action lawsuit settlement will divided amongst Class Members, minus the attorneys’ fees, court costs and incentive awards, and distributed to H&R Block employees the following way:
(1) Each Class Member will be awarded 10 “tax season points” for each tax season in which he/she was employed as a Seasonal Tax Professional in California between 2007 and May 2011. (For example, if a Class Member was employed in the 2007 and 2009 tax seasons, that individual would be awarded 20 tax season points.)
(2) Each Class Member will awarded an additional 20 tax season points for each tax season between 2007 and may 2011 in which he/she received “Additional Compensation” (paid by H&R Block in May each year) as a Seasonal Tax Professional.

To receive any money from the H&R Block wage class action lawsuit settlement, you must submit a claim form postmarked no later than May 21, 2012.
