G4S Secure Solutions agreed to a $1,758,625 Fair Credit Reporting Act (FCRA) class action lawsuit settlement to resolve claims it violated federal law with unfair background checks.
The settlement benefits G4S Secure Solutions employees and applicants to whom the company provided an FCRAÂ disclosure and authorization fund since July 21, 2019.
G4S Secure Solutions is a part of G4S Global — a company that provides security services, cash solutions, consulting services, and care and justice services around the world. The company has been hired for jobs such as manning border security in Estonia, upgrading security at the Turkish Bank, and developing a safety standard for a European car manufacturer.
However, according to a class action lawsuit against the company, G4S Secure Solutions violated federal law with its employee applicant background checks.
Plaintiffs in the case say that G4S used a background check form when procuring background checks. This form allegedly failed to comply with disclosures and other requirements required by the federal FCRA.
The FCRA guarantees employees and job applicants with various rights and holds employers to a number of standards when requests, running and acting upon background checks. Employers must get written permission before running a background check and their disclosures must comply with FCRA requirements. Additionally, companies are limited in what they can ask about an applicant or employee’s background.
According to the FCRA class action lawsuit, G4S Secure Solutions failed to comply with these and other FCRA requirements when requesting and running background checks on employees and applicants.Â
G4S Secure Solutions hasn’t admitted any wrongdoing but agreed to resolve these allegations with a class action lawsuit settlement.
Under the terms of the settlement, class members can receive a cash payment of $25. These payments will not be considered wages for tax purposes and will instead be considered penalties. Settlement payments will result in a 1099 form the class member will be responsible for.
Unclaimed checks from the settlement will be voided and resulting funds will be used to pay settlement administration costs. If over $120,000 remains in the settlement fund, this amount will be donated to a cy pres recipient.Â
The deadline for exclusion and objection is Sept. 10, 2022.Â
The final approval hearing for the FCRA lawsuit settlement is scheduled for Sept. 28, 2022.
In order to receive a payment from the settlement, class members must submit a valid claim form by Sept. 10, 2022. Claim forms can be submitted on the settlement website. Class members can also update their address and contact information on the settlement website.
