A California state court judge agreed to certify a class action lawsuit accusing Google of gender discrimination, including in pay and promotions for female employees.  

San Francisco Superior Court Judge Andrew Y.S. Cheng certified a Class of 10,800 women employed with Google as software engineers and in other roles over the past eight years in an order issued Thursday. An additional subclass of more than 6,000 women who were hired by Google before 2017, and were not campus hires, was certified by Judge Cheng as well.  

“The court finds that because this case can be adjudicated using common evidence, proceeding as a class action is superior to requiring thousands of putative class members to pursue individual claims,” stated the certification order in the Google pay boas class action lawsuit.  

The decision to go forward with certification marks the latest blow against Google over claims its employment policies and practices led to lower pay for women and fewer advancement opportunities.  

The Google pay bias class action lawsuit was filed by a group of female Google employees in 2017. The plaintiffs accused the company of systematically discriminating against women in matters of compensation and promotions. As a result, female Google employees are allegedly paid less than male employees performing comparable work.  

The four plaintiffs each claimed that they were placed in lower-paying career tracks, that male employees with comparable qualifications were promoted over them, and that, overall, they were denied access to similar pay and career opportunities at Google. 

According to the Google gender bias class action lawsuit, the plaintiffs ultimately left Google because of the lack of career advancement opportunities for women at the company. 

Though Google refused to comment directly on the certification of pay bias Class Members, it told Law360 that it “strongly believe[s] in the equity of our policies and practices.” 

“If we find any differences in proposed pay, including between men and women, we make upward adjustments to remove them before new compensation goes into effect,” a spokesperson for Google told reporters.  

“We look forward to prosecuting this case on behalf of the class and subclass in order to get Google to change its pay practices so that it pays women the same pay as men performing substantially equal work and so that it stops assigning women to lower salary levels than men with comparable education and experience,” one of the lawyers who represent the plaintiffs and newly certified Class Members told Law30 Thursday.
