A woman from Florida has filed an Arby’s overtime class action lawsuit alleging that the fast food chain failed to properly pay employees according to overtime regulations.
The plaintiff, Tamara D., filed this Arby’s overtime class action lawsuit on behalf of all those in a similar situation.
According to Tamara’s lawsuit, she was left unpaid a total of $4,301.25 in overtime compensation during around three years of working with Arby’s. Indeed, the lawsuit claims, Tamara worked up to fifteen hours of overtime per week during her time as an Arby’s employee between March 2014 and February 2017, totaling around 870 hours she would be owed overtime payment.
Tamara alleges that though she was paid regular hours for her overtime work, Arby’s failed to pay her at the overtime rate, ultimately owing her over $4,000 in unpaid overtime wages.
The Arby’s overtime class action lawsuit claims that this was not a simple mistake by Arby’s, but instead done despite having knowledge of the plaintiff’s overtime work and the laws regarding overtime wages.
Tamara’s Arby’s overtime class action lawsuit alleges that the company violated the Fair Labor Standards Act (FLSA), which requires employees be paid time and one-half of her regular hourly rate during the overtime hours she worked; that is, above the 40 hours of work per week.
The Arby’s overtime class action lawsuit also applies to Class Members in a similar situation. Class Members are those who are non-exempt employees of Arby’s who worked overtime hours during the time period covered in this Arby’s overtime class action lawsuit: March 2014—February 2017.
Tamara filed her Arby’s overtime class action lawsuit on March 13, 2017.
