A $1 million settlement has been reached in a class action lawsuit accusing Dice Inc. and DHI Group of illegally compiling and disseminating reports on job candidates.
Dice was accused of using consumers’ public social media reports to create “candidate profiles” and then allegedly provided access to those profiles to third parties.
Class Members include consumers who had a Dice candidate profile starting on July 26, 2012 and who either asked Dice to delete the profile or whose profile was accessed by a third party.
Plaintiffs accused Dice, along with its parent company DHI Group, of obtaining and disseminating consumer reports in violation of the Fair Credit Reporting Act.
According to the class action lawsuit, Dice consumer reports failed to meet federal standards required under the Fair Credit Reporting Act, or FCRA.
According to the Dice consumer reports class action lawsuit, the company compiled reports on individuals based on information posted publicly on social media accounts. Dice would then provide access to their so-called “candidate profiles” to third party employers.
The plaintiffs in the Dice FCRA class action lawsuit claim that the company failed to meet standards under federal law. Dice reportedly failed to show that it had a “permissible purpose” to create and disseminate reports.
Additionally, the company allegedly failed to obtain certifications required under the FCRA from third parties accessing Dice’s reports confirming that they were using the profiles for permissible employment purposes.
Further, Dice didn’t provide sufficient notice to individuals about whom the company compiled reports, the plaintiffs claim.
Dice contends that the reports it compiled, the candidate profiles, do not fall under the FCRA.
The Dice consumer reports FCRA class action settlement will end the litigation if approved.
Under the terms of the settlement, the company will pay $1 million to Class Members. Dice has also agreed to change its business practices by allowing consumers to access, request changes to, and even delete their profiles.
Further, businesses and other third parties must agree to updated Terms of Service.
Class Members are expected to receive between $50-$200, but may receive as much as $500 for submitting a valid and timely claim. Claims can be submitted electronically. Class Members must provide their Notice ID and Confirmation Code shown at the top of the Notice email. Class Members who do not have this information must contact the Settlement Administrator.
The deadline for Class Members to exclude themselves is May 27, 2019. The deadline to object to the Dice consumer reports FCRA class action settlement is July 19, 2019.
Who’s Eligible
“All individuals about whom Defendants created an Open Web profile and (a) for whom a third party used a feature on the Open Web profile to communicate with the individual or (b) the individual requested deletion of their Open Web profile. The Class Period is from July 26, 2012 to the date that the Class List is prepared.”

How do we know if we were contacted as the calls are not titled when they call. I did file online for a job but not sure if this is the culprit for so many calls are unending coming in.
