A $3.75 million settlement has been reached to resolve claims that ServiceSource failed to pay their employees all of their wages.

The settlement benefits individuals who were employees by ServiceSource in Nashville, Tenn. between Sept. 21, 2009 and Oct. 17, 2018.

A variety of positions are eligible for payment under the settlement with further information available in the “Who’s Eligible” section below.

Plaintiffs Sarah Patton, Erica Kitts, and Marilee Harrison filed their class action against ServiceSource Delaware Inc., claiming that the company failed to pay employees all of the wages they were owed under the Fair Labor Standards Act (FLSA) and Tennessee state labor laws.

Employees were allegedly denied overtime pay despite working over 40 hours a week and being classified as non-exempt. These employees were allegedly classified as hourly workers and they were reportedly entitled to time and a half pay for hours worked over 40 hours a week.

“Defendant has intentionally and repeatedly engaged in a practice of improperly and unlawfully failing to pay their non-exempt employees including, but not limited to, the Plaintiffs and the collective group of similarly-situated employees who worked at Defendant’s Nashville, Tennessee location for work performed in violation of the provisions of the FLSA and corresponding federal regulations,” the ServiceSource class action lawsuit claimed.

The amount each Class Member can collect will depend on the number of weeks worked as a ServiceSource employee. All of the weeks worked by Class Members will be added up and used to determine a pro rata share of the fund. Then, Class Members will receive compensation based on the number of weeks worked.

It should be noted that if Class Members file for compensation under the FLSA collective, they will not be able to seek compensation for those workweeks under the Rule 23 Settlement Class.

Claim Forms need to be received or postmarked by April 30, 2019. If Class Members wish to object to or opt out of the settlement, they must do so by May 15, 2019. The final approval hearing is scheduled for June 5, 2019.

Who’s Eligible

FLSA Collective: all current and former hourly paid, non-exempt employees at the ServiceSource Nashville office who performed uncompensated work activities between Oct. 31, 2015 and Oct. 31, 2018.

Rule 23 Settlement Class: individuals who were employed by ServiceSource in Nashville, Tennessee between Sept. 21, 2009 and Oct, 17, 2018 as a sales account representative, senior sales representative, strategic representative, renewal sales representative, renewal sales specialist, strategic sales specialist, customer success associate, customer success representative, customer success specialize, sales associate, sales representative, or channel engagement specialize.

Potential Award

Varies depending on the number of weeks worked by a Class Member.
