Retail workers have reached a $1.3 million settlement which will resolve a California Dollar Tree uniform class action lawsuit.

If you worked at a California Dollar Tree between July 13, 2013 and Dec. 13, 2018, as non-exempt employee, you could get $15 from this class action settlement.

A Dollar Tree class action lawsuit accused the discount retailer of forcing workers to pay for a required work uniform without providing reimbursement in violation of California employment law.

According to the Dollar Tree class action, workers were forced to purchase and wear a “distinctive” color combination — black pants and a green shirt — while working at most of the 360 Dollar Trees in California.

According to the California Dollar Tree uniform class action lawsuit, workers are entitled to reimbursement for uniform costs when the clothes they are required to wear to work cannot be used outside of the workplace.

The plaintiffs alleged that their Dollar Tree uniform was not generally wearable outside of work; however, Dollar Tree shot back, contending that, in addition to the green and black, a combination of white shirt and tan or khaki pants were also admissible for employees.

The discount retailer initially agreed to pay workers $8.80 each in order to settle the California Dollar Tree uniform class action lawsuit. That settlement agreement was rejected by a federal court. The judge found that the award to the Class Members was too little and the administrative costs too high.

In the most recent California Dollar Tree uniform class action settlement, Class Members can receive $15.81. In addition, if any of the $1.3 million settlement amount remains after the Claim Form deadline has passed, the remaining amount will be distributed to Class Members.

Dollar Tree continues to contend that employees can dress in more options than the green shirt and black pants alleged by the class action lawsuit and that it is not required to reimburse employees for work clothing.

Class Members will be automatically entered into the settlement and do not need to submit a Claim Form. Class Members who need to update their address will need to print and mail a change of address information form to the settlement administrator.

The deadline to object to or opt out the the Dollar Tree uniform class action settlement is May 6, 2019.

“All non-exempt hourly store employees employed by Dollar Tree Stores, Inc., in California, during the period from July 13, 2013, to December 13, 2018.”
