Delivery drivers have managed to secure a $5.5 million settlement which would end a IntelliQuick driver wages class action lawsuit.

Class Members include couriers and other delivery drivers who worked for IntelliQuick, an Arizona delivery service, between April 9, 2009 and July 7, 2018 and were classified as “independent contractors.”

According to IntelliQuick’s website, “With more than 250 uniformed and credentialed delivery driver agents and a national affiliated network, IQ is able to offer fulfillment of any local delivery or logistics need in the Southwestern U.S. with warehouse, fulfillment and cross docking operations in Phoenix, Tucson, Las Vegas and Denver.”

Lead plaintiffs accused the delivery service of failing to pay delivery drivers appropriately. According to the IntelliQuick driver wages class action lawsuit, the company misclassified workers as “independent contractors” and failed to pay minimum wage or overtime.

The IntelliQuick class action lawsuit also accused IntelliQuick of failing to keep proper time and pay records, violating both state and federal worker protection laws, including the Fair Labor Standard Act or FLSA.

The IntelliQuick driver wages class action lawsuit was filed by three IntelliQuick drivers on April 19, 2012. A Class of current and former drivers was certified in July of that year.

The majority of the Class Members have been identified, according to the settlement agreement. However, 96 current or former IntelliQuick drivers who were classified as independent contractors have not yet been identified and can opt into the settlement.

Claims can include unpaid minimum wages or overtime for work performed by Class Members between April 8, 2009 and July 7, 2018.

Class Members must provide their SIMID number that will be provided on the notice. Class Members who did not receive notice or who cannot find their SIMID number can contact the settlement administrator at 833-200-6669.

Class Members who wish to exclude themselves or opt out of the IntelliQuick driver wages class action settlement, including those who object to the wage calculation determined for their claim, must do so by April 23, 2019.

Who’s Eligible

Class Members include current and former IntelliQuick couriers and delivery drivers who worked in Arizona between April 9, 2009 and July 7, 2018.

Potential Award

Varies depending on if the Class Member is an FLSA Opt-In Class Member or a Rule 23 Class Member or both.

  • Gross Settlement Damages for FLSA Opt-In Class Members are the amounts calculated by Plaintiffs’ expert as total unpaid wages due (i.e., overtime wages, minimum wages and overtime premiums on minimum wages) times two for the time period beginning 3 years prior to the filing of each FLSA Class Members’ individual opt-in Consent to Sue form up through July 7, 2018.
  • Gross Settlement Damages for Rule 23 Class Members are the amounts calculated by Plaintiffs’ expert as the wages due (i.e., overtime wages, minimum wages and overtime premiums on minimum wages) plus interest on such wages due for the time period beginning April 9, 2011, which is one year prior to the filing of the Lawsuit, through July 7, 2018.
  • Gross Settlement Damages for Settlement Class Members who are both Opt-in FLSA Class Members and Rule 23 Class Members are the greater of their Gross Settlement Damages as an FLSA Opt-in Class Member or their gross Settlement damages as a Rule 23 Class Member but not both.”
