no asbestos sign illustration design over a white backgroundA North Carolina plaintiff recently filed an asbestos mesothelioma lawsuit against 3M Company, alleging the company and other defendants were responsible for his mesothelioma diagnosis.

The plaintiff, Wade G., filed this asbestos mesothelioma lawsuit after being diagnosed with mesothelioma in May 2015.

According to the asbestos mesothelioma lawsuit, Wade G. was exposed to asbestos for decades in his occupation as a carpenter, insulator and maintenance worker for Daniels Construction in North Carolina.

The lawsuit alleges that, in his duties for the company, he was exposed to products and equipment containing asbestos.

These products and equipment were made by a wide range of companies, including American Standard Equipment, Erie City Boilers, General Electric, 3M and others that he included in the lawsuit.

The plaintiff’s mesothelioma has led to physical, mental and emotional pain and suffering, as well as significant medical expenses, the lawsuit alleges.

The plaintiff filed his asbestos mesothelioma lawsuit on multiple counts, including negligence, inadequate design or formulation, breach of express warranty, willful and wanton conduct, false representation/fraud and failure to warn. His wife also added charges of loss of consortium.

By filing the asbestos mesothelioma lawsuit, Wade G. is requesting a number of compensatory and punitive damages to cover the losses he has suffered because of his asbestos mesothelioma.

These damages include hospital and medical expenses, loss of past and future earnings, loss of health, and loss of consortium, among others.

Asbestos Mesothelioma

Mesothelioma is a cancer that attacks the lining of the lungs, and has been primarily associated with exposure to asbestos.

Because of this, construction workers make up a large number of those who file asbestos mesothelioma lawsuits, as they have often spent years surrounded by products and equipment made with asbestos.

Asbestos is a naturally occurring mineral used for commercial purposes such as electrical or building insulation, as well as countless other uses. Asbestos’ microscopic fibers can accumulate in the lungs.

Asbestos lung cancer takes decades to develop, but quickly spreads to distant organs. Because of these factors, asbestos lung cancer is commonly diagnosed at a late stage of development, which makes it significantly more dangerous for patients.

Asbestos Mesothelioma Lawsuits

According to this asbestos mesothelioma lawsuit and others like it, the company the plaintiff worked for was aware (or should have been aware) of the dangerous nature of their asbestos-containing materials before and during the time that the plaintiff worked for them.

These lawsuits allege that, for these reasons, the plaintiff’s asbestos exposure and subsequent diagnosis was foreseeable and should have been anticipated and avoided by the defendants.

The asbestos mesothelioma lawsuit alleges that defendants failed to warn their workers, including the plaintiff, of the damaging and possibly fatal consequences linked with the use of their asbestos-containing products.

Many people exposed to asbestos, often construction workers, have filed asbestos cancer lawsuits after being diagnosed with mesothelioma.

If you or someone you know has been diagnosed with or died from an asbestos-related disease, and have been exposed to asbestos, you may be able to file an asbestos mesothelioma lawsuit.

The 3M Asbestos Mesothelioma Lawsuit is Case No. 1:15-cv-00465 in the U.S. District Court for the Middle District of North Caroline, Durham Division.
