mesothelioma lawsuitIn a recent Tennessee news report, an old morgue in Memphis was found to contain asbestos, putting the construction workers remodeling the morgue at mesothelioma risk due to asbestos exposure.

According to the news story, during recent construction at the morgue located at 1060 Madison, asbestos literally “oozed out of the walls, floors, and ceiling.”

The morgue, which was built before the 1970s and is no longer in use, is being rehabbed. A representative of employees doing the work says they found old asbestos in the walls, floors, and ceiling, and are concerned for their safety and the safety of their loved ones.

Construction workers at the site say they are now at a higher mesothelioma risk due to asbestos exposure in the old morgue.

“They are concerned not only for their physical and emotional well-being, but also for their families who are exposed when they return home carrying asbestos in their clothing,” a representative for the workers stated in a letter addressed to the mayor.

The mayor responded with a statement noting that there is hidden asbestos inside the building but that those working inside were never in any danger of mesothelioma risk due to asbestos exposure.

“If you find asbestos in the building then there are certain protocols that you follow to assure that only people who are removing the asbestos are trained to remove the asbestos are in the building until the building is cleaned. So that was the procedure we followed,” the mayor told the news reporter.

The mayor’s response is not unusual. Throughout much of the 20th century, employers refused to acknowledge that asbestos was sickening their workers.

Even when the medical community was warning them of mesothelioma risk due to asbestos exposure, countless businesses continued their use of asbestos, opting for this material rather than something more expensive.

The result was generations of individuals burdened with asbestos-related diseases, the worst of which is mesothelioma, a cancer that can take decades to develop but kills quickly once discovered.

Mesothelioma Risk Due to Asbestos Exposure

Asbestos still can be found across the country in buildings, roads, homes, schools, factories, ships, trains and automobiles. It’s regulated in the U.S., but it is not banned. A surprising number of products are still made with asbestos, including automobile brakes and clutches, roofing materials and several other construction products.

Demolition crews and construction workers are particularly susceptible to mesothelioma risk due to asbestos exposure. As older buildings with asbestos in their walls, floors, attics, ceilings and roofs are torn down, demolition crews, bulldozer and crane operators, and other laborers can become exposed to asbestos dust.

OSHA enacted laws in 1997 that further limited the presence of asbestos to 0.1 fibers per cubic centimeter at any job site. Employers are required to provide safe working conditions and protective clothing and equipment to employees working around asbestos in order to prevent mesothelioma risk due to asbestos exposure.

Yet, the impact of decades of asbestos exposure for countless individuals cannot fully be understood yet, as the latency period for mesothelioma is typically between 20 and 50 years.

Because of the negligence of many companies, potential lawsuits and legal action may be pursued. Attorneys assisting clients in filing claims against employers may help mesothelioma patients and others recoup burdensome medical costs.
