Carnival Corp. Unpaid Overtime Class Action Lawsuit

By Kimberly Mirando

Carnival Corporation

A former employee has filed a class action lawsuit against Carnival Corporation claiming the company has been stiffing workers out of overtime pay since 1998.

Germain Dieulifaite, a former house keeper for Carnival, alleges in the class action overtime lawsuit that he and other non-exempt employees regularly worked over 40 hours per week but were not paid overtime compensation of time and one-half wages for all of the overtime hours they worked, as required by law.

Dieulifaite is asking the court to certify his case as a class action lawsuit on behalf of all similarly situated Carnival employees. The class action lawsuit is also asking the court to make Carnival pay Class Members for all overtime hours they worked at one and one-half their regular rate of pay, plus liquidated damages equaling 100% of the overtime due to them for the hours they worked but were not properly compensated for in the past three years.

A copy of the Carnival Unpaid Overtime Class Action Lawsuit can be read here.

The case is Germain Dieulifaite v. Carnival Corporation, Case No. 12-cv-20805-WMH, U.S. District Court, Southern District of Florida.
