Kohler Wage Class Action Lawsuit Certified

A federal judge has certified a class action wage lawsuit against Kohler Co. that accuses the company of not paying its administrative employees for all hours they worked.
The newly certified Kohler wage class action lawsuit will cover about 140 administrative employees who allege Kohler permitted them to work “off the clock” to finish assigned work without being paid. The Kohler employees say they often had to complete their assignments before or after their assigned shifts and/or during their unpaid lunch breaks. Kohler knew the employees were working off the clock, but did not pay them for their additional work time, the class action lawsuit says.
“Just because Kohler has a policy of disallowing overtime does not negate the company’s obligation to pay its employees for work they perform to complete their assigned duties,” said one of the attorneys representing the employees.
Federal Magistrate Judge William Callahan Jr. ruled that the workers only needed to demonstrate that they worked uncompensated overtime on the employer’s premises to create a presumption that the employer knew or should have known about the additional work time.
Current and former Kohler administrative employees will receive a notice of the class action lawsuit and be provided the option to opt of out the suit if they choose.
