Certain current and former Wells Fargo employees may be able to receive compensation thanks to a $96 million class action settlement with the company.

The Class is made up of all persons employed by Wells Fargo Bank N.A. in California as a Home Mortgage Consultant, Home Mortgage Consultant Junior, Private Mortgage Banker, or Private Mortgage Banker Junior (HMCs) at any point between March 17, 2013, and Dec. 31, 2019.

A class action lawsuit had alleged Wells Fargo’s compensation system for these employees in California failed to provide paid rest periods, failed to pay vacation pay, and failed to pay minimum wage for all hours the employees worked.

The $95,696,122.35 gross value of the settlement includes  $25,696,122.35 already paid by the company in Jacqueline I. v. Wells Fargo.

As of March 2021, Wells Fargo had 70 million customers and was the 20th-largest employer in the United States.

Ninety percent of the net fund value will go to rest-period claims for Wells Fargo HMCs in California between March 17, 2013, and March 31, 20218. Each Class Member will receive a proportionate share of this allocation based on the number of delays they worked during that period and recorded at least 3.5 hours in the timekeeping system.

Ten percent of the net fund value will be allocated for non-rest-period claims for the relevant Wells Fargo employees who worked in California at any point between Oct. 27, 2013, and Dec. 31, 2019. Class Members will receive a proportionate share of this amount based on the number of days they worked in California during that period and recorded any time in the timekeeping system.

A final hearing in the Wells Fargo class action settlement will take place Sept. 15, 2021.

The deadline for Class Members to opt out of or object to the settlement has passed.

Class Members do not need to take any action in order to benefit from this settlement.
