Claims are now being accepted in the $5.6 million Wynn Las Vegas dealer tips settlement.

Those who are eligible to make a claim include plaintiffs and collective action members. This refers to the individuals who filed Notices of Consent in the Cesarz Action and/or the Tang Action, and those who are members of the proposed collective who have not yet filed a notice of consent to joinder in either of those actions; plaintiffs are listed in Exhibit A of the settlement agreement.

The Wynn dealers settlement affects about 1,000 current and former dealers, according to the Las Vegas Review-Journal.

Lead plaintiffs in two opt-in collective action lawsuits — the aforementioned Cesarz Action and Tang Action — accused Wynn Las Vegas of violating the Fair Labor Standards Act (FLSA) by including boxmen and casino service team leads in the tip pool.

Wynn Las Vegas denies all allegations of wrongdoing.

Wynn Resorts operates luxury casino resorts in Las Vegas, Boston, and Macau, according to the company’s corporate profile.

After attorneys’ fees and other litigation costs are paid, the plaintiffs and collective action members will receive a portion of the net settlement fund.

Seventy percent, or about $2.9 million, of the net settlement amount will be allocated for claims in the Tang case.

The remaining 30 percent — about $1.25 million — will be allocated for claims in the Cesarz case.

Each individual’s award will be based on a pro rata assessment of the tips they received during the relevant time period: March 23, 2018, to Nov. 11, 2018, in the Tang case, and Jan. 31, 2017, through March 22, 2018, in the Cesarz case.

Some Wynn dealers settlement plaintiffs and collective action members who worked during the relevant period for both groups will receive two separate awards.

Wage payments shall be reported on an Internal Revenue Service (IRS) Form W-2. Non-wage payments shall be reported on an IRS Form 1099. 

These form statements will be prepared by the settlement administrator.

A final hearing date in the Wynn dealers settlement is not available.

Claim forms must be submitted by June 15, 2021.
