Defendants in an Amazon class action lawsuit have agreed to a $8.2 million settlement benefitting certain delivery drivers.

The Class is made up of anyone who was employed by one of the following delivery service providers and made deliveries to Amazon customers in Washington state at any time between Dec. 20, 2014, and July 31, 2020:

  • Dash Delivery LLC
  • Delivery Force Corp.
  • Jungle Trux Inc.
  • A-1 Express Delivery Service, Inc. d/b/a 1-800 Courier
  • Progistics Distribution Inc.
  • Revelation Delivery Inc.
  • Genesis Delivery Inc.
  • Transportation Brokerage Specialists Inc.

Three former delivery drivers had filed an Amazon class action lawsuit accusing the company and the other defendants — Jungle Trux Inc., Scott Aitchison, and Timothy O’Neal — of violating Washington wage and hour laws, as well as Seattle’s municipal code.

Amazon works with a number of delivery service providers to deliver thousands of packages every day, according to the company’s jobs website.

The defendants deny any allegations of wrongdoing but have agreed to a settlement.

Each Class Membre will be eligible to receive a proportional share of the Amazon class action lawsuit settlement fund.

The payments will be based on Class Counsel’s expert’s calculation of the average alleged damages per work week by delivery service provider and the number of weeks each Class Member worked for each provider.

Damages calculations will be based on payroll and timekeeping data from the providers, as well as delivery data provided by Amazon. 

If there are no appeals, Class Counsel expect the first payments to go out within 75 days of the Court granting final approval.

Half of each Class Member’s gross settlement share will be reported to the government as wages and will be subject to employee payroll tax withholdings and payments.

The other half will be reported as non-wage damages and interest. No taxes will be withheld from this half, but it will be considered taxable income.

No claim form is required for Class Members to participate in the Amazon class action lawsuit settlement.

An approval hearing is scheduled for May 7, 2021.

Exclusion and objection requests must be submitted no later than April 12, 2021.

    I worked for Jungle Trux for over one year during the period under dispute. I have been following the case and finally wrote to the representing attorneys that I have not received any payments. Workers had no control how the funds were paid. May I kindly get my share. There is no proof that any check was sent to me.
