A mother and grandfather have filed a class action lawsuit against Pittsburgh schools, a teacher, a former principal, as well as a school officer alleging students with disabilities are subject to excessive use of restraints.
Lead plaintiffs have filed the class action lawsuit against Pittsburgh schools on behalf of students with disabilities, including their son identified by the initials “D.C.”
They say that the students have been subject to the unlawful use of restraints, including handcuffs and physical restraints, in violation of the Americans with Disabilities Act and Rehabilitation Act.
According to the class action, Pittsburgh schools “rely on inappropriate disciplinary procedures and law enforcement in lieu of appropriate supports” for students with disabilities.
“As a result of being subjected to unnecessary and excessive handcuffing and unlawful physical restraints, Plaintiff D.C. and the Class experienced pain, fear, emotional trauma, and an exacerbation of their disabilities,” contends the class action lawsuit.
D.C. was enrolled in kindergarten in Pittsburgh schools in the 2015-2016 school year, according to the Pittsburgh school class action.
He has been diagnosed with Attention Deficit Hyperactive Disorder (ADHD), say D.C.’s mother and grandfather, and qualifies as “handicapped” under the Americans with Disabilities Act.
According to the class action lawsuit, D.C. began experiencing trouble in school with his behaviors escalating.
While D.C.’s mother agreed to seek outpatient treatment, she says that the school offered no other recommendations, supports, or interventions to help.
Unfortunately, the problems continued into D.C.’s next year as a first grader. D.C. was suspended after an altercation with another student, but Pittsburgh schools allegedly failed to start evaluating the child for special education supports and services.
Outside of the school, D.C. was eventually diagnosed Oppositional Defiance Disorder in addition to ADHD, alleges the class action lawsuit. However, the school failed to provide services and D.C.’s behavior continued to deteriorate.
According to the Pittsburg school class action lawsuit, in October 2016 D.C. was unlawfully restrained by a longtime substitute teacher and police officer in a number of incidents.
Once, after D.C. threw a chair and a desk, a teacher allegedly laid D.C. down and placed a knee on his back.
The Pittsburg school class action lawsuit further alleges that as D.C.’s behavior continued to deteriorate, he was subject to further unlawful restraint, including a report that a teacher choked him and later the child was placed in a physical restraint by untrained personnel.
Throughout this time, according to the class action lawsuit, Pittsburgh schools failed to initiate an evaluation that would allow D.C. and his mother to access special education services and supports.
Instead, claims his mother, the school said that she should place D.C. on medication before bringing him back.
Ultimately, alleges D.C’s mother, she had to obtain help from an outside education advocate to assist in her meetings with the school district about her son.
The Pittsburgh schools class action lawsuit seeks to represent other students like D.C. who were subject to unlawful restraints or handcuffing “from the District’s failure to provide sufficient special education services, and through the pervasive reliance on School Police Officers to discipline students with disabilities.”
The plaintiffs are seeking damages as well as a court order requiring Pittsburg schools to come into compliance with laws protecting students with disabilities.
The lead plaintiffs are represented by Jeffrey J. Ruder and Kristen C. Weidus of Ruder Law.

My son was diagnosed with asperger’s and oppositional defiant disorder and ADHD and anxiety and aggressiveness is do to asperger’s and in kendergarden he was kick out 6 times every week on Tuesday for 3 day for tipping a desk kicking a garbage can him and another kid taking a pencil and tapping each other on head and took his thin folder and taped a kid on the head and one tim I was in meeting 8n office and my son was in class a teacher had speach problem and spit when he talked or yelled so my son said can you please back up your spitting in my face ask him three times and he wouldn’t back up after my son told he didn’t want his germs he hit him my son hit him and the teacher said if you apologize I wont take you to the office he said I ask you to back up your spitting in my face and you would not three times and I said please and we are told to protect our self’s from germ and you were wrong and principal said he hot teacher he has to be kicked out so I called board of education and telling him what is going on with your teacher kicking him out for little things that a kindergarten will do to try your patient and he has disability and you guy are kicking him out and they are also babys just lieing home and want to be home and will do anything to be home with mom and dad he also had separation anxiety also he even was the first kid in Harrison county to have swine flu and when we tryed to get him to go back he could go his asperger’s autism spectrum disorder over come him and he could not go in the big class with all those kids he ended up getting sick having the shaks like he was having a seizure and started puking and the teacher would try to get him to come in then one day at school he was trying so hard and got upset and knocked his desk over they had six teachers hold my baby kindergarten down they feared him completely of school after already having anxiety from asperger’s and then while getting help from Bradley center which they were wrong and upset my son told him information he was not surpose to no on a home visit so he decided he didn’t want to go back and the Bradley center let’s them know if these children run do not hurt them bring them safely back to parents and we told them we found him and they stop my husband in my sisters truck Clarksburg police and tell my husband get you for harvoring a run away he told that cop no you cant I reported him missing and called and said I found him and the cop told my 13 year old autistic son to get out of car and was going to put cuffs on him and mind you he was out of med ro so he was so scared and full of anxiety and ran and that cop used full force on Him and broke his collar bone and cut his knees up his hands his back up I think his head was cut to and he told him your hurting me he said good your going to act like an adult I’m gonna treat you like one and he told him sevel time he was hurting him and he needed to get his arm checked and he still ripped his arm behind his back cause a space between the bone hopefully it heals right and I could go on but that should tell you alot
