ExamSoft Bar Exam Glitch Overview

  • Who: July 2021 bar examinees are reportedly considering legal action after their computers crashed during the test.  
  • Why: Test takers say they lost precious time during the required legal licensing test.  
  • Where: No litigation has been filed yet, but test takers from multiple states reported problems with ExamSoft technology last week. 

July 2021 test takers are reportedly considering a class action lawsuit against the software company ExamSoft Worldwide Inc after technical problems caused computers to crash during the remote bar exam.  

The problems started at the very beginning of the July testing period on Tuesday with examinees reporting that their computer screens went blank, costing them exam time, according to Reuters. Would-be attorneys reportedly posted pictures of blank screens on social media and say that they were forced to reboot. Others told reporters that they were locked out of the exam, some for more than an hour.  

“We are aware of the technical issues some examinees faced during today’s administration,” the National Conference of Bar Examiners said in a statement. “While (the National Conference) does not administer the exam, we are communicating with ExamSoft to seek solutions for those affected.” 

ExamSoft Responds to Complaints 

ExamSoft is a computer software company that specializes in computerized assessment and assessment-administration programs. The company provides bar exam software for nearly 90 percent of the United States, including remote bar exam services during the coronavirus pandemic.  

“We’re working with the jurisdictions to accommodate those who may have experienced verified issues to make sure that all applicants are able to complete every session,” ExamSoft spokeswoman Nici Sandberg told reporters at the time.  

The company first claimed that problems were due to the computer memory in certain devices, according to Reuters. Now, some are considering a class action lawsuit against the software company which charges bar takers more than $100 for the use of its services.  

“We continue to investigate what caused some exam-takers to experience technical difficulties, but do not believe that there is any merit to or basis for a lawsuit,” Sandberg told Reuters

This is not the first-time glitches have marred the bar exam. In 2014, test takers in 43 states reported problems uploading essay responses, a problem so widespread it earned the moniker “Barmageddon.” In 2015, ExamSoft agreed to pay $2.1 million to end class action lawsuits filed by frustrated test takers in the wake of July 2014 exam software problems.

    my examsoft crashed during the february 2021 north carolina UBE bar examination and I was not allowed to renter the exam- thereby unable to complete and pass the exam.
