The PG&E Fire Victim Trust portal has been established in order to benefit California victims from the Butte Fire of 2015, the North Bay Fires of 2017, and the Camp Fire of 2018 that burned through Northern California. The trust is now accepting benefits claims.
The Fire Victim Trust was established as part of PG&E’s bankruptcy proceedings. The company reportedly faced billions of dollars of liability from claims filed by those affected by fires, in addition to other financial difficulties. The company has accepted its responsibility in California wildfires, saying that faulty equipment played a role in sparking blazes.
Potential beneficiaries include those people, families, and businesses who were affected by the Butte Fire of 2015, the North Bay Fires of 2017, and the Camp Fire of 2018 and who filed a claim against the company over injuries that they suffered.
Those fire victims eligible for benefits might have suffered a range of losses, including damage to personal property, damage to real estate, or destruction of these items. Those people who suffered physical injury, emotional injury, additional living expenses, lost wages, business losses, and other injures are also eligible. The families of those who lost their lives in the fires are also eligible for compensation through the PG&E Fire Victim Trust.
To be eligible, a fire victim must have filed a claim with the company in bankruptcy court on or before Dec. 31, 2019. Those who did not file such a claim by the deadline are not eligible to collect benefits from the PG&E unless they received relief from the Bankruptcy Court allowing them to file a late claim. In this case, they must have submitted a claim in Bankruptcy Court within 30 days after they were permitted to file late.
If you have filed a claim against PG&E in bankruptcy court but were not allowed to do so, or if you have withdrawn your claim, you are not eligible to file a claim from the Trust.
The Fire Victims Trust portal acknowledges that some circumstances or cases might emerge that are not covered by the broad terms set out by the PG&E Fire Victim Trust. In these instances, potential claimants can contact the claims administrator with questions, if they are not covered in the information provided by the trust.
Potential claimants were identified and sent a notice from the information that they provided in bankruptcy proceedings.
The trust will consider eight kinds of claims for benefits:
- Real property
- Personal property
- Personal home losses
- Business losses
- Other out-of-pocket expenses
- Wrongful death
- Personal injury
- Emotional distress
Claimants can submit claims for other damages, which will be considered by the trust’s administrators, to determine if they are recoverable per California law or other applicable laws.
To submit a claim, claimants must submit a questionnaire in the fire victims trust portal by Dec. 31, 2020.
Documentation will be required to support your claim, which can include a range of information. This can include purchase information for your property, tax records, renderings of your property from engineers or architects, pre-fire photos and videos, post-fire videos, and other information.
