Unless Congress acts, the time to file claims on the federal 9/11 Victim Compensation Fund will be over very soon as money available runs out. As things currently stand, the fund for first responders and others exposed during the attacks will expire next year.
Although a New York City CBS affiliate reports that lawmakers on both sides of the aisle are working to extend the fund, they have not said how much the cost would be or where funding would be obtained for 9/11 victims.
What is the 9/11 Victim Compensation Fund?
The 9/11 Victim Compensation Fund (VCF) was set up shortly after the events of Sept. 11, 2001, in order to provide money for medical treatments to those who were in Lower Manhattan that day, or their survivors. This includes first responders (police, paramedics and firefighters) as well as those who had businesses, were employed, resided or attended school in the area.
The collapse of the World Trade Center released tons of carcinogens and other toxic chemicals into the air that day and for many days afterward. As a result, first responders and other survivors have suffered from a wide range of illnesses and disabilities, most of which will require a lifetime of medical treatments, therapy, and health monitoring. The primary intention of the 9/11 Victim Compensation Fund is to compensate these victims for medical costs.
Why is the Fund Running Out?
As of July 2018, there was close to $7.4 billion available for the payment of victim claims. However, in August, a “reassessment” of the 9/11 Victim Compensation Fund and its policies and procedures found that the money could run out before the program was scheduled to end. It was therefore determined that claimants with the most serious illnesses be given priority.
When is the Expiration Date?
If Congress fails to take action, the VCF will expire on Dec. 31, 2020. As it is, people who filed claims after February of 2019 are seeing substantially reduced payouts. The reason is to be able to give everyone something, even if it is not a full amount. Hopefully, Congressional action will rectify this situation going forward, but there are no guarantees.
Is Anything Being Done to Keep it Going?
On June 9, members of Congress announced that bipartisan efforts were underway to preserve and expand the VCF for as long as may be necessary. Speaking to CBS News, Rep. Peter King (R-NY2) said that their efforts are “…sending a signal that if, God forbid, something like this should happen in the future, America will stand by those who are wounded or killed in action.”
What Illnesses/Conditions are Eligible?
There are over 70 different cancers that are eligible for coverage under the 9/11 Victim Compensation Fund. Other health conditions that may not be eligible for VCF compensation – including psychological issues such as PTSD – may be covered under WTC Health Program.
