bottle of RK Pure 250 Raspberry KetoneA recent class action lawsuit claims that the maker of RK Pure 250 Raspberry Ketone uses false claims to advertise their weight loss supplement.

Plaintiff Chaim Rubinstein says Weight Loss Products LLC markets its RK Pure 250 Raspberry Ketone capsules as a “weight loss miracle.”

The “100% PURE, NATURAL” capsules are claimed to provide “extremely high antioxidants” and be “completely natural.”

The RK Pure 250 Raspberry Ketone class action lawsuit alleges that the company urges consumers to not “settle for imitations” and to purchase their product instead, which contains “NO wheat, gluten, corn, soy, salt, yeast, dairy, artificial colors or flavors, sweeteners or preservatives.”

Rubinstein argues that these representations are false and that Weight Loss Products misleads their customers in an attempt to drive sales.

“In fact, neither Formula specifically nor raspberry ketones generally have been validated as a ‘fat-burner’ in human beings, contrary to WLP’s many representations. Nor is the Formula ‘Natural’ or ‘100% Natural,’” the RK Pure class action lawsuit claims.

Rubinstein takes issue with the product’s “natural” claims, arguing that RK Pure Raspberry Ketones are chemically synthesized.

Raspberry ketones occur naturally within nature but they are typically at very low levels.

The ketone class action claims that instead of using natural ketones that can cost up to $20,000 per kg, Weight Loss Products uses synthetic raspberry ketones. Due to this, the products are allegedly not natural.

The RK Pure Raspberry Ketones class action also challenges the “fat burning” claim on its capsules. Despite claims that “Raspberry Ketones have been clinically tested and shown to help break down and burn fat,” raspberry ketones have allegedly not been shown to cause weight loss in humans.

Some laboratory research performed on rodents suggests that extremely high doses of raspberry ketones may help prevent weight gain, but these products have allegedly never been shown to have the same effects in low doses taken by humans.

The plaintiff says that as recently as November 2018, experts have concluded that raspberry ketones are not evidenced to cause weight loss. This conclusion has reportedly been upheld by numerous institutions including the Cleveland Clinic Foundation, the Mayo Clinic, Massachusetts General Hospital, and the United Kingdom’s Professional Jockeys Association.

“The formula is ‘snake oil’ and yields no material fat burning benefits to anyone,” the ketone class action claims.

Despite the alleged lack of evidence supporting their claims, Weight Loss Products reportedly continues to market their Raspberry Ketones as natural and capable of burning fat in humans.

Rubinstein argues that this false advertising is a violation of New York consumer protection laws. He seeks to hold the company accountable for their claims under the state laws that require honesty in advertisements.

The plaintiff seeks to represent a Class of consumers who purchased the RK Pure 250 Raspberry Ketone in New York.

The ketone class action lawsuit seeks statutory damages, actual damages, punitive damages, court costs, and attorneys’ fees.
