Charlotte’s Web is a company that sells CBD and hemp infused products, including lotions and balms. Charlotte’s Web Hemp Infused Cream is advertised as a moisturizer that can calm dry skin and support skin revitalization, due to ingredients including shea butter, vitamins B5 and E, and hemp extract. Although Charlotte’s Web advertises that the company’s cream contains 300 mg of hemp extract per ounce, third-party testing has indicated that the cream may contain far less of this substance.

Are Charlotte’s Web Hemp Products Mislabeled?

According to consumer reports and third-party testing, Charlotte’s Web products including Charlotte’s Web Hemp Infused Cream may contain much less CBD and hemp than is advertised on the label. According to testing conducted by Leafly and published online in November 2019, Charlotte’s Web cream contained only 53 percent of the advertised levels of CBD. Leafly tested 47 CBD products and found that around 35 percent of these products contained less than 80 percent of the advertised CBD levels, or no CBD at all.

If Charlotte’s Web products have been mislabeled, victims who have purchased these products based on false claims may be able to file a lawsuit against the manufacturer and pursue reimbursement and compensation. At least one lawsuit has already been filed against Charlotte’s Web due alleged mislabeling.

What is Hemp-Derived CBD?

CBD is derived from cannabis and hemp plants. However, it does not cause psychoactive side effects. Instead of causing a high, CBD enthusiasts claim that the substance may have many positive health effects, including reducing anxiety and soothing chronic pain. Over the past several years, the CBD market has exploded in popularity due to these alleged benefits. The CBD market was worth approximately $600 million in 2018 and is expected to hit $23.7 billion by 2023.

CBD may be used to relieve symptoms of depression, anxiety, PTSD, and insomnia, as well as to treat nausea, vomiting, or pain. Skincare and makeup brands have also been experimenting with adding CBD to their products, due to the substance’s alleged anti-inflammatory properties.

Although the Farm Bill from 2018 legalized hemp-derived CBD products, these products are still subject to regulations regarding product labeling,as well as what claims may be made about CBD health benefits. According to some studies and product testing, many CBD products may contain less CBD than advertised on the label. As CBD products are relatively new to the market and are not yet subject to strict regulations, CBD brands may be taking advantage of this lack of regulations.
