Consumers may be able to claim as much as $100 in a class action settlement over claims Cobra Sexual Energy products were falsely advertised by their manufacturer, Nutraceutical.

California residents who purchased Cobra Sexual Energy products between Aug. 14, 2009, and Dec 31, 2020, may be able to take part in the $100,000 settlement agreement.

Lead plaintiff Troy Lambert first filed a class action lawsuit against Nutraceutical in 2013 over its alleged false advertising of the purported aphrodisiac product. According to the complaint, statements on Cobra Sexual Energy capsules’ packaging declared the product was a “powerful men’s formula” and would allow purchasers to “perform [their] best with animal magnetism.”

Lambert also pointed out the packaging included pictures of a snake with “clear phallic overtones.” Indeed, the product is sold in an orange box, containing a bottle with 120 capsules. Both the box and the bottle include a picture of a cobra rising from the ground.

Despite these representations, the class action lawsuit contended the ingredients in Cobra Sexual Energy products could not produce the advertised results. The plaintiff claimed the advertising duped consumers into thinking the product would improve their sexual ability when there was no evidence the ingredients would do so.

In addition, one ingredient, yohimbe extract, could potentially cause health problems, the complaint claimed. According to the National Institutes of Health’s National Center for Complementary and Integrative Health (NCCIH), yohimbe has been linked to heart attacks, seizures, stomach problems, anxiety, high blood pressure and other side effects.

The class action lawsuit snaked its way through the court system, first being certified in 2014 only to be decertified in 2015. In fact, the case made it all the way to the U.S. Supreme Court and was recertified in January 2020.

While Nutraceutical maintains it did nothing wrong, it has agreed to pay $100,000 to end the litigation.

In addition, the company has pledged to modify its labeling practices to avoid misleading consumers further. Specifically, the company has agreed to change the terms “potency wood” and “virility” in its marketing materials, along with modifying a statement regarding Cobra Sexual Energy’s effect on blood flow.

Under the terms of the class action settlement, Class Members can claim up to $100 with proof of purchase or up to $10 without. According to settlement documents, the exact amount each Class Member will receive will also depend on the total number of claims submitted.

To make a claim, Class Members must submit a Claim Form either online or by mail, along with proof of purchase if they have it, by March 6, 2021.

Class Members who wish to object to or exclude themselves from the Cobra Sexual Energy class action settlement must also do so by March 6, 2021. A final hearing is scheduled for April 2, 2021.

    The website is down for this lawsuit. You can type it in by hand, or go through google and still it does not connect. They might need to provide an extension for claims.
