A Bayer class action lawsuit alleges Flintstones sour gummy vitamins are falsely advertised as being free of artificial flavors even though they contain synthetic DL-malic acid.
Plaintiff Angela Madatovian says she purchased sour Flintstones gummy vitamins after reading the statement “free of artificial flavors” on the label. She says she was misled into purchasing the product because she had no way of knowing the product contained artificial flavoring when she made the purchase.
Malic acid is the common name for 1-hydroxy-1 2-ethanedicarboxylic acid, the Bayer lawsuit explains. Malic acid has two different arrangements of molecules: l-malic acid and d-malic acid. L-malic acid occurs naturally in fruits while d-malic acid does not occur naturally.
The Bayer vitamins allegedly contain DL-malic acid, which is made from petroleum products.
Madatovian says malic acid creates the sour flavoring in many fruits and the synthetic DL-malic acid is used to create the sour flavoring in the Flintstones gummy vitamins.
She claims in the Bayer class action that the company’s false and misleading claims about the gummy vitamins deprived her and other class members of their interest to choose the type and quality of products they consume.
Plaintiff says Flinstones vitamin false advertising cost her time and money
As a result of the alleged false advertising, Madatovian says she has experienced lost money, wasted time, and “stress, aggravation, frustration, loss of trust, loss of serenity and loss of confidence in product labeling.”
Madatovian filed the Bayer lawsuit on behalf of herself and a proposed nationwide class of consumers who purchased the allegedly mislabeled Flintstones vitamins within the last four years. She also seeks to represent a California subclass.
The Bayer class action lawsuit asserts claims for violations of the California False Advertising Act and Unfair Business Practices Act.
Earlier this year, a California federal judge refused to certify a class representative in a class action lawsuit alleging Flintstones Complete multivitamin gummies were falsely advertised as “complete.”
