A new class action lawsuit accuses Ultimate Guitar of automatically renewing consumers’ subscriptions without their knowledge or consent.

Plaintiff Steven Teilmann filed the class action complaint against Ultimate Guitar on June 25 in California federal court, alleging violations of state and federal consumer laws.

Ultimate Guitar is a music instrument platform that offers a wide range of courses and song tracks, including chords, tabs and lyrics.

According to the lawsuit, Ultimate Guitar engages in an illegal automatic renewal scheme with respect to its subscription plans for software products and services available exclusively to consumers who enroll in its auto-renewal membership programs.

Ultimate Guitar subscription terms fail to provide proper disclosures, lawsuit says

Teilmann claims that Ultimate Guitar surreptitiously enrolls consumers into a program that automatically renews their subscriptions from month-to-month or year-to-year, resulting in monthly or annual charges to their credit card, debit card or third-party payment account.

Teilmann argues Ultimate Guitar fails to provide the requisite disclosures and authorizations required to be made to California consumers under the state’s Automatic Renewal Law (ARL).

Specifically, Teilmann claims that Ultimate Guitar fails to present the automatic renewal offer terms in a clear and conspicuous manner and in visual proximity to the request for consent to the offer before the subscription or purchasing agreement is fulfilled, which is in violation of California law.

Further, Teilmann claims Ultimate Guitar charges consumers’ payment methods without first obtaining their affirmative consent to the agreement containing the automatic renewal offer terms and fails to provide an acknowledgment that includes the automatic renewal offer terms, cancellation policy and information regarding how to cancel in a manner that is capable of being retained by the consumer.

The lawsuit alleges Ultimate Guitar also makes it exceedingly difficult and unnecessarily confusing for consumers to cancel their subscriptions, thus violating the ARL.

Teilmann wants to represent anyone in the United States who, within the applicable statute of limitations period, up to and including the date of final judgment in this action, incurred renewal fees in connection with Ultimate Guitar’s offerings for paid subscriptions.

He is suing for violations of California’s Unfair Competition Law, conversion, violations of California’s False Advertising Law and Consumers Legal Remedies Act, unjust enrichment, negligent misrepresentation and fraud. He is seeking certification of the class action, damages, fees, costs and a jury trial.

In related news, a Washington federal judge sanctioned Amazon for withholding more than 70,000 documents in the Federal Trade Commission’s lawsuit alleging the company used deceptive practices to enroll users in auto-renewing Prime subscriptions.

OnlyFans.com also recently faced a class action lawsuit alleging it violated California law by automatically enrolling consumers in membership programs without providing clear and conspicuous disclosures.
