Disney Movie Club has agreed to pay $2.5 million to resolve claims it enrolled Californians in automatic subscriptions without their consent. The settlement deal provides cash payments to eligible consumers.

The settlement benefits California residents who were enrolled in the Disney Movie Club between July 30, 2015, and Dec. 4, 2020.

Several plaintiffs filed their class action lawsuit against Disney Interactive Studios in December, arguing they had been wrongfully enrolled in Disney Movie Club subscriptions without their consent. According to the plaintiffs, these subscriptions violated California auto-renewal laws.

The company allegedly enrolled consumers in the program after offering a deal of four movies for $1. After these movies, consumers are allegedly sent unsolicited DVDs from the Disney Movie Club and are charged over $20 for each movie.

Although Disney justified its actions with a fine-print disclaimer on its website, the plaintiffs argued this agreement was not enough to justify enrolling them in an automatic subscription.

“For the reasons explained below, the purported agreement to purchase additional movies and the purported right for Disney to post charges to the consumer’s credit or debit card as payment for such additional movies are invalid and unenforceable under California law,” the Disney Movie Club class action lawsuit alleged.

“Furthermore, under California law, all movies subsequently shipped are deemed to be a ‘free gift’ to the consumer, without any obligation to return them or pay for them.”

Disney Movie Club has not admitted any wrongdoing but has agreed to resolve the claims against it with a $2.5 million settlement deal. The settlement provides cash payments to affected consumers, though estimates for payment amounts are not currently available. Exact payment amounts will vary depending on the number of claims filed and the net settlement fund amount after costs, fees and expenses are deducted.

In order to benefit from the settlement, Class Members must file a valid claim form by March 9, 2021. Claims will be validated using personal information (name, addresses, telephone numbers, emails, and CPT ID if known).

The deadline for exclusion and objection is March 9, 2021. The final approval hearing for the settlement is scheduled for May 21, 2021.

California residents who were enrolled in the Disney Movie Club between July 30, 2015, and Dec. 4, 2020.
