Forjas Taurus has agreed to pay $38 million to settle allegations that Rossi revolvers are prone to discharge if dropped due to a defect.
Class Members include those who purchased Rossi brand .38 Special and .357 Revolver models manufactured between Jan. 1, 2005 and Dec. 31, 2017. Consumers must have owned the guns as of March 15, 2019.
The serial numbers on these guns will begin with letters A through K, Y, or Z. Those Class Members who may have sold these guns to third parties are encouraged to inform them.
The Rossi revolver class action lawsuit argued that the resolvers have a “drop fire” defect, and despite the defect, the maker of Rossi revolvers touted the gun’s safety measures.
In addition to the defect that caused the Rossi revolvers to be prone to drop fire, the complaint contended that a second defect caused the internal safety feature to malfunction.
The second defect, alleged the plaintiffs, left the guns with no internal mechanism that would prevent the revolvers from discharging due to a hammer spur impact — a possibility if the gun is dropped or jostled.
One of the lead plaintiffs alleged that she suffered an injury due to the Rossi revolver drop fire defect. The class action lawsuit accused the gun maker, Brazilian company Forjas Taurus, of failing to warn consumers of the defect or issuing a recall.
Forjas Taurus denies any wrongdoing, but has agreed to pay nearly $40 million to exit the Rossi revolver “drop fire” class action lawsuit. Personal injury claims are not included as a part of the settlement agreement.
Under the terms of the settlement, Class Members can send their affected revolvers in for inspection and repair, along with a cleaning, receive an enhanced warranty and claim a $50 inconvenience fee.
Further, the company has established an Early Warning Program. The Early Warning Program is meant to inform current and former Rossi revolver owners of the potential drop fire dangers of the weapons and encourage them to get them inspected and repaired if necessary.
Class Members must file a claim either online or by mail to take advantage of the Rossi revolver “drop fire” class action settlement. Once Class Members have filed a valid claim, they will receive a box, shipping label, and instructions for sending their Rossi revolver in for inspection, repair and cleaning, along with the $50 cash award.
The deadlines to opt out of or object to the Rossi revolver “drop fire” class action settlement have passed. The deadline to make a claim is Oct. 22, 2020.
The settlement administrator will only be collecting paperwork, DO NOT send your revolver to the settlement administrator.
Who’s Eligible
“The Class includes all individuals in the United States, including its territories and possessions, who owned one or more Class Revolver(s) on March 15, 2019.”
“‘Class Revolvers’ means Rossi brand revolvers of the following models—R35102, R35202, R85104, R97206, R97104, R46202, R46102—manufactured by Forjas Taurus during the Class Period, as indicated by the serial number stamped on the frame of the revolvers beginning with the letters Y, Z, A, B, C, D, E, F, G, H, I, J, or K.”
Potential Award
$50 cash along with inspection, cleaning, and repair (if necessary) of the revolver.

Sent the .38 spcl back 2019 and haven’t got it back yet. Apparently you need to do something I haven’t done.
I will take my chances.
They aint gonna keep my gun and not send me back another one. Its a bunch of bull.
Screw Rossi and this lawsuit.
Buyer beware. You pay the least for a pistol, what do you expect.
My Smith and wesson has no issues.
