A new class action lawsuit against Hatch Baby, the manufacturer of the popular Rest 1st Generation Sound Machine, claims the productโs power adapter poses a serious shock hazard to consumers due to defective design.
Plaintiff Thomas Durst filed the class action complaint against Hatch Baby Inc. on Aug. 26 in California federal court, alleging violations of state and federal consumer laws.ย
The lawsuit comes after the company recalled more than 900,000 power adapters that were sold with one of its sound machines marketed to soothe babies and children, as the adapter can pose a shock hazard.
โPlaintiff purchased the Product, while lacking the knowledge that [it] could shock those who use [it[, thus causing serious harm to those who use such Products,โ the lawsuit states.
The complaint claims that the power adapter sold with the sound machine can break apart when removed from the wall socket, leaving the metal prongs exposed.ย
This defect allegedly presents a risk of electric shock to consumers.ย
Durst and other affected customers across the United States purchased the product under the assumption that it was safe for household use, he says.ย
Hatch Baby power adapter recall issued after reports of problems
Hatch Baby issued a recall for the defective power adapters on July 3, 2024, after numerous reports of the adapter breaking apart.ย
The adapters, which were sold primarily through online retailers like Amazon and in stores such as Target, Walmart, and Best Buy, were produced by Jiangsu Chenyang Electron Co. in China.ย
The recall came after years of sales, leaving many customers potentially exposed to the defect, the lawsuit alleges.ย
Durstโs lawsuit claims that Hatch Baby failed to inform consumers of the risk prior to the recall, violating state and federal laws. The plaintiff alleges that had he known about the hazard, he would not have purchased the product or would have paid less for it.
The class action lawsuit seeks to represent anyone who bought the Rest 1st Generation Sound Machine between January 2019 and May 2024.
Durst is seeking certification of the class action lawsuit, damages, fees, costs and a jury trial, as well as an order that Hatch Baby reformulate the product to eliminate the shock hazard.
