Procter & Gamble, makers of Align probiotics, is looking at an October 2016 trial date for its massive class action lawsuit affecting those who used the Align products.
Those who purchased Align probiotics between Mar. 1, 2009 and June 6, 2016 in California, Illinois, North Carolina, Florida or New Hampshire may have the right to an Align probiotic settlement.
Critics of the product claim that Procter & Gamble falsely advertised their Align probiotics products.
They say that the company asserted that Align was supposed to aid in digestive health, but it did not do what Procter & Gamble claimed it would.
The Class in this lawsuit is requesting an Align probiotic settlement because Procter & Gamble claimed that Align “is different because only Align contains Bifantis, a patented probiotic strain” that “brings peace to your digestive system” and provides a “restored natural balance to your digestive system.”
Allegedly, this does not happen with Align probiotics use and plaintiffs are calling for an Align probiotic settlement.
What is Bifantis?
Align claims to contain a unique strain of healthy bacteria called Bifantis. Procter & Gamble claims that Bifantis was developed by digestive specialists and will “naturally balance your digestive system.”
Procter & Gambles also note that Bifanitis, in Align, should be taken daily.
Probiotics are live bacteria and yeasts that are good for digestive health. Probiotic supplements in food have only been popular since about the 1990s but have recently grown in popularity.
Align probiotics products made by Procter & Gamble were released in 2009.
Align’s Claims
The makers of Align probiotics claims that Align does three things in particular. These things are listed on the label.
According to the label, Align builds and maintains a healthy digestive system, it restores your natural digestive balance and it protects against occasional digestive upsets.
The Align class action lawsuit that was filed in 2012 states that there is no scientific evidence or studies to back up any of these claims.
The lawsuit claims that the claims are “are false and misleading and reasonably likely to deceive the average consumer.”
Additionally, Align’s tagline is “Great Digestion Through Science.” The plaintiffs, seeking an Align probiotic settlement, claim that Procter & Gamble has no legitimate basis to make any such claims.
In fact, the lawsuit suggests that Align probiotic is “nothing more than a sugared capsule filled with naturally occurring bacteria.”
Reportedly, in at least two Align studies done to discover the effects that Bifanitis and Align probiotics had on symptoms like abdominal pain, bloating, urgency and gas, no impact on the symptoms was observed.
