A dog and a man outsideA California man is suing Hill’s Pet Nutrition, alleging his dog suffered health complications due to toxic dog food.

Plaintiff William Albion alleges the company’s Science Diet dog food products had caused his dog to suffer numerous health complications related to vitamin D toxicity. Albion says he purchased a variety of Science Diet dog food products from Hill’s over the past three years including between April 2018 and May 2018.

According to the claim, Albion owns a sheepapoodle named Stella and fed her Hill’s Pet Nutrition dog foods under the impression that they were premium products that were healthy for his dog. Albion says he fed Stella Hill’s Science Diet Adult Perfect Weight Chicken & Vegetable Entrée Dog Food, Hill’s Science Diet Adult 7+ Healthy Cuisine Roasted Chicken, and several other varieties.

However, Stella reportedly started suffering serious health complications in May 2018, after she was fed the Science Diet products. According to the lawsuit, Stella began presenting symptoms of vitamin D poisoning including vomiting, nausea, and lethargy.

Albion says when he stopped feeding Stella these varieties of dog food, she recovered from her symptoms very quickly.

The lawsuit alleges Albion had paid premium prices for these products and had relied on the products’ labels and marketing statements, each of which reportedly described the products as a healthier alternative for dogs.

After consulting a product recall class action lawyer, Albion opted to file legal action against Hill’s after discovering at least some of the dog food products he fed Stella between April to May 2018 were recalled for vitamin D poisoning.

Overview of Science Diet Dog Food Recall

Consumers began getting concerned over potentially toxic dog food in late January 2019, when Hill’s Pet Nutrition recalled several products of their Prescription Diet and Science Diet canned dog food.

Hill’s said the recalled dog food could contain too much vitamin D, which can cause toxicity symptoms in dogs. In more serious high exposure cases, dogs could also develop life threatening complications like kidney failure. The recall was recently expanded to cover:

  • Hill’s Prescription Diet i/d Canine Chicken & Vegetable Stew 12.5 oz.
  • Hill’s Prescription Diet Metabolic + Mobility Canine Vegetable & Tuna Stew 12.5 oz.
  • Hill’s Prescription Diet w/d Canine Vegetable & Chicken Stew 12.5 oz.
  • Hill’s Science Diet Adult 7+ Small & Toy Breed Chicken & Barley Entrée Dog Food 5.8 oz.
  • Hill’s Science Diet Puppy Chicken & Barley Entrée 13 oz

Hill’s reportedly learned of the potential excessive vitamin D levels after receiving consumer complaints, which described symptoms of toxicity. Hill’s reportedly concluded that at least one of their products contained excessive vitamin D due to a supplier error.

The Hill’s Pet Nutrition Class Action Lawsuit is Albion v. Hill’s Pet Nutrition Inc., Case No. 5:19-cv-00935-MWF-KK, in the U.S. District Court of Central California.
