Mid-America Pet Food LLC is facing a pet food class action lawsuit over concerns it manufactured and sold pet food that was contaminated with salmonella and caused pets to become sick. The potentially contaminated pet food salmonella products were subsequently recalled.
The Mid-America class action lawsuit notes that the defendant manufactures and sells pet food products under several brand names, including Victor Super Premium, Wayne Feeds, Eagle Mountain and Member’s Mark.
On Sept. 3, Mid-America reportedly recalled one lot of Victor Super Premium Dog Food Hi-Pro Plus manufactured at its production facility in Mount Pleasant, Texas due to potential pet food salmonella contamination.
Salmonella is a group of bacteria that can cause symptoms such as vomiting, diarrhea, fever, loss of appetite and abdominal pain if ingested, the pet food class action lawsuit explains. Humans can reportedly become ill if they handle pet food that has been contaminated with salmonella.
The U.S. Food and Drug Administration reported that the recall was issued because a sample of the pet food had tested positive for salmonella in a random sample test conducted by the South Carolina Department of Agriculture, according to the Mid-America class action lawsuit.
A second pet food salmonella recall was issued on Oct. 30 to include three lots of Victor Super Premium Dog Food Select Beef Meal & Brown Rice Formula, and the recall was expanded to include pet foods with Best By dates before Oct. 31, 2024.
Plaintiffs say their pets became ill due to Mid-America pet food salmonella contamination
Plaintiffs Courtney Andersen and Lisa Burmeister each claim to have purchased Mid-America pet food products that were subject to the pet food salmonella recall. They say their pets became ill after eating the allegedly contaminated pet food products, and Burmeister’s previously healthy dog ultimately had to be euthanized due to the severity of her sickness.
Burmeister notes that she and her son also became ill around the same time as their dog.
The pet food class action cites estimates from the Centers for Disease Control and Prevention that salmonella causes approximately 1.35 million illnesses, 26,500 hospitalizations and 420 deaths in the United States each year.
Because the risks posed by salmonella contamination are so great, the plaintiffs argue that manufacturers should have quality control standards to prevent sourcing and use of ingredients contaminated by salmonella.
The Mid-America class action lawsuit asserts claims for negligence, negligent misrepresentation, breach of express warranty, breach of implied warranty of merchantability, fraudulent concealment and unjust enrichment.

Im a French bulldog breeder all seven of my dogs were infected along with the pregnant mother that just had puppies. One of my dogs had to be euthanized because she had severe Gastro problems and two others are still going through it and may end up with the same fate I am from North Texas as well and the food here was contaminated .
My dog is now dead as well my second has liver problems.
My dog was sick from October thur December. I never realized it was the dog food. Now that we switched dog food, the dog has recovered.
I’ve been waiting for this! Mid America Pet Food (MAPF) and Victor and NOT refunded my 5 unopened bags of Max-5 Pro Beef and Rice with dates from July 2023 through Oct 2023! 40 lbs x $69 + tax! Count me in abd you can have pictures or the actual unopened bags as proof! They out our a refund page but only allow 1 photo then say it is insufficient evidence! I have gotten the run around since Nov 2nd when I was aware if the recall. No sick dogs thank heavens or I would have gotten my own attorney for lack of support from these parties.
