A class action lawsuit claimed the defendant, Schell & Kampeter Inc., doing business as Diamond Pet Foods, misleadingly represented and advertised the products as being grain free, when lab tests allegedly detected grain among the products’ ingredients.
Diamond Pet Foods products are sold at retailers throughout the United States, including Petco, Tractor Supply Co., Chewy.com, Amazon, and others.
The defendants have denied all allegations of wrongdoing, and the Court has not ruled in favor of either party. Both parties believe the settlement to be in the Class’ best interest.
Class Members who submit proof of purchase with their valid claim will receive $10 for each product, up to a maximum of $100 per household.
Those without proof of purchase may still make a claim; these claimants will receive a single $5 payment per household.
A final hearing is set for Aug. 20, 2021.
Anyone who wishes to request to be excluded from or to object to the settlement must do so by July 30, 2021.
The claim form deadline is Oct. 4, 2021.
