Temu copyright infringement lawsuit overview:

  • Who: Online marketplace Temu is disputing a lawsuit filed by online marketplace Shein.
  • Why: Shein claims Temu improperly used thousands of its copyrighted images as promotional photos on its website.
  • Where: The lawsuit was filed in the Chancery Division of the High Court of Justice of England and Wales.

Online marketplace Temu denied claims it used thousands of images Shein copyrighted as promotional photos on its website.

Shein filed a lawsuit against Temu in September over claims it used the images to make consumers believe it sold the same products as Shein, Law360 reports.

Temu, meanwhile, reportedly argues it was not aware the images in question belonged to Shein, one of its rivals in the online marketplace industry.

The company acknowledged some of its website pictures were “identical” to Shein’s but says it does not know copyright ownership for an estimated 30 million images it uses across a total of 4 million product listings, Law360 reports.

Shein also reportedly accused Temu of altering the copyrighted photos to conceal they were being unlawfully used. Temu argues third-party sellers made these changes.

Temu argues it was not given enough time to review Shein letter

In June, Shein sent a letter to Temu that included examples of more than 8,000 URLs of allegedly copyrighted photos. Temu claimed Shein did not own the copyright for the photos at that time, Law360 reports.

Temu also reportedly argued it was not given enough time to realistically review the contents of the letter and was not properly informed about the alleged copyright infringement.

Shein previously received an emergency temporary restraining order against Temu in a U.S. court in July over copyright claims, with Temu noting in its current defense that that decision was simply a “temporary measure” and not proof of infringement, Law360 reports.

A consumer filed a class action lawsuit against Temu in September, arguing the company fails to protect its customers’ data, allegedly causing widespread and systematic theft of their personally identifiable and financial information.

Temu is represented by Charlotte May KC and Henry Edwards of 8 New Square and Allen & Overy LLP.

The Temu copyright infringement lawsuit is Roadget Business Pte. Ltd. and another v. Whaleco UK Ltd., Case no. IL-2023-000132, in the Chancery Division of the High Court of Justice of England and Wales.

I’ve had this experience, as well as every time I got an order it was wrong, or not even close to the picture or description. Please Add Me To This Lawsuit!

I have used Temu for many years. So products are great, some are crap. In general, I’ve not had a problem with Temu. One time they were late with delivery, I received a $5 credit. I will say, trying to return something is not worth the trouble. Since the tariffs have gone ‘wherever’, Temu is not worth ordering from, there is now a “shipping fee” on each individual item. They say it’s from local suppliers but prices have doubled and tripled. They say to order from the same supplier to save on shipping, but, the supplier is never listed. As far as Data Breach, this is the first I’ve heard of it.

  3. Dorothy Laarveld says:

I’ve been with Temu for about 4 years now and when I ordered I’ve had problems with returning wrong items and getting my credit I have to fight with them

    $487.
They did. They took that money and they also took $165 out of my account. They took $145 out of my account. And they just kept taking money the same day and they would not give me my money back into my account
