Viega ProPress Copper Fittings Class Action Settlement

Viega has agreed to provide $15 million in benefits as part of a class action lawsuit settlement resolving claims it violated antitrust laws to fix the price of Viega ProPress copper fittings. Under the settlement, indirect purchasers will be able to collect payments of up to 25 percent of their purchase amounts and/or class action rebates of up to $500.

The settlement benefits individuals who purchased Viega ProPress copper fittings from a wholesale distributor between Jan. 29, 2015, and Sept. 18, 2020. Consumers who purchased Viega ProPress fittings directly from the manufacturer are not included in this settlement.

Plaintiffs in the Viega ProPress copper fittings class action lawsuit argued that the press fitting manufacturers entered into illegal agreements with distributors in order to encourage the sale of their products.

Allegedly, these agreements bound distributers not to sell copper press fittings from competitors. If distributors did sell competitor products, they were allegedly charged a higher wholesale price for Viega ProPress copper fittings.

As a result of these agreements, consumers were reportedly forced to pay more for Viega ProPress copper fittings or were denied the ability to seek out competitive prices from other brands.

Viega has not admitted any wrongdoing under antitrust laws as alleged by the plaintiffs. However, the company has agreed to establish a $10 million settlement fund and a $5 million class action rebate fund to settle the claims against them.

Viega Class Action Lawsuit Settlement Benefits

The $10 million settlement fund will be distributed amongst consumers who made purchases of Viega ProPress copper fittings between Jan. 1, 2015 and Sept. 18, 2020. From this fund, consumers will be eligible to recover refunds of up to 25 percent of their total eligible purchases.

Future payments made between Dec. 18, 2020, and Dec. 31, 2021, will also be eligible for payments through a $5 million rebate program. Under this program, Class Members in the Viega class action lawsuit settlement can submit claims for payments of up to $500 each.

In order to receive initial cash payments from the settlement, Class Members must file a valid claim form by Dec. 15, 2020. However, Class Members have until March 1, 2022, to file a claim for future cash class action rebates.

Claim forms must include proof of purchase, such as distributor or wholesaler invoices, receipts or other proof of purchase provided by a distributor or wholesaler. Documentation must specify the purchase of qualifying Viega ProPress copper fittings, the purchaser, a date of purchase during the Class Period, the item/product purchased and price, the supplier and proof of payment.

Class Members have until Nov. 30, 2020, to exclude themselves from the settlement or object to the terms of the deal.

Who’s Eligible
