toro riding lawnmowerA class action lawsuit asserts that The Toro Company sold defective TimeCutter lawn mowers that can spontaneously catch on fire.

The Toro lawn mower class action lawsuit was filed by Scott Gruenwald who claims that he purchased a new 2014 Toro TimeCutter riding lawn mower for around $3,500 in 2014.

Gruenwald says that on June 27, 2018, after normal, intended use of the mower, it unexpectedly caught fire while it was parked in his garage that was connected to his house.

The Toro class action claims that the fire spread from the garage and into his home, which engulfed his entire house and resulted in the loss of his home. Allegedly, an investigation conducted later by an independent expert discovered that the origin of the fire was the Toro mower.

Gruenwald says that he was partially compensated for his property loss by his insurer, Pekin Insurance Company, and notes that the insurance company is filing a separate lawsuit against Toro over the issue.

The Toro mower fire class action lawsuit says that Toro TimeCutter driving mowers pose a serious safety risk to users and properties because they possess a defect that causes them to spontaneously catch fire.

Allegedly, Toro is aware of the fire problem but has not sufficiently handled the problem. Gruenwald says that Toro recalled some affected mowers, made in 2015. However, the plaintiff asserts that this recall was insufficient because it did not include the 2014 mower, which Gruenwald purchased.

Gruenwald says that on Nov. 24, 2015, when Toro announced the recall of the 2015 TimeCutter mowers, the company said that the defect was caused by “fuel filters on the mowers that can become brittle and fractured, allowing fuel to leak,” which can in turn, cause a fire.

Allegedly, customers whose 2015 TimeCutter mowers were subject to recall were told that they could receive a free replacement fuel filter in the mail that they could install themselves, or that a Toro dealer could install.

However, this benefit was reportedly not provided to owners of the Toro TimeCutter 2014, which had the same problem.

Gruenwald said that he and many other owners of the 2014 TimeCutter mowers were financially injured by Toro, because had they known that the mowers were defective, they would not have purchased them or would not have paid as much for them.

He seeks damages on behalf of himself and all other similarly affected consumers.

Gruenwald is represented by Daniel Gustafson, Karla M. Gluek, and Amanda M. Williams of Gustafson Gluek PLLC, by Kenneth A. Wexler and Mark J. Tamblyn of Wexler Wallace LLP, and by James Pepper of The Pepper Law Firm LLC.

The Toro TimeCutter Lawn Mower Defect Class Action Lawsuit is Scott Gruenwald v. The Toro Company, et al., Case No. 0:19-cv-02294, in the U.S. District Court for the District of Minnesota.

My Toro timecutter 5000, only 3 years old, started smoking. I turned it off and went inside house. About 30 minutes later, a loud explosion. The entire mower was in flames and burned to the ground. Had to get the firemen to put the flames out. Totally burned, I never knew there were faulty problems and recalls. I contacted Toro, and they offered me 10% discount on a new Toro. Told me to have my homeowners Ins. pay for it. I contacted my homeowners ins. my deductable is $2500. I paid $3500, for this mower only 3 years ago. Totally out, Toro refused to even have someone look at it. If I had not gotten off the mower, I would have lost my life or limbs. Horrible company. would love to post picture, it won’t let me.

    2. Charlene D. says:

We have a 2015 SW5000 zero turn timecutter and we have had many different problems with a wheel locking up, starter problems, just the whole mower seems as if it is falling apart. And we clean the deck and maintain it properly. Right now it is down with the wheel problem and my grass is to my knees. We never would have bought if we knew the problems we would have. And they started right away after buying!!

  8. Sue happy says:

How well did he maintain his mower? I have seen mower decks with so much dry grass on them I am surprised that they do not catch fire. After 4 years of use I have a hard time believing it was the mowers fault. Also after 4 years, and the appropriate maintenance was done the fuel filter would have been replaced.
