Spa pumps fire class action overview: 

  • Who: A Bestway USA spa pump customer, plaintiff Danielle Harper, is suing the company.

Weeks after hundreds of thousands of spa pumps were recalled when they were found to cause fires — including one fatal incident — consumers are suing the company responsible for the pumps.

Plaintiff Danielle Harper filed the class action complaint against Bestway USA Inc. on Sept. 27 in a Pennsylvania federal court, alleging violations of state and federal consumer laws. 

Last month, about 866,000 AirJet and HydroJet spa pumps manufactured by Bestway were recalled after the pumps reportedly caused at least three fires, including one fatal house fire in January.

The recall was published to the U.S. Consumer Product Safety Commission (CPSC) website Sept. 12, stating that the AirJet and HydroJet spa pumps can overheat, causing the plastic housing to ignite and posing a fire hazard.

In the spa pumps class action, Harper alleges consumers were put at risk by the spa pumps, which she states contain “serious safety defects.” She argues that Bestway failed to disclose these defects, endangering thousands of consumers who purchased the products.

Spa pumps class action claims Bestway’s response inadequate

Bestway spa pumps with model numbers P05332, P05339, P05711, P05807, P07000, and others are part of the major Sept. 12 recall.

With at least one death linked to the defect so far, the lawsuit also raised concerns about the safety of other units still in circulation.

Despite the recall, Harper alleges that Bestway’s response has been inadequate, leaving consumers with devalued and potentially dangerous spa pumps.

Many only learned about the defect through social media rather than direct communication from the company, she claims. Harper alleges that Bestway failed to provide timely recall information, exacerbating the problem.

The lawsuit also criticizes Bestway’s marketing and advertising practices, accusing the company of promoting the spa pumps as high-quality, reliable products. 

Harper says she trusted Bestway’s reputation when purchasing her spa pump from Amazon in November 2022. The complaint argues that Bestway actively promoted its spa pumps, making “bold claims” about their quality while knowing about the defect, and convincing consumers like Harper that they were buying safe and dependable products. 

The reality is far from the company’s promises, Harper claims, with consumers now facing the risk of serious injury or property damage due to faulty products.

As a result, she’s looking to represent anyone who purchased the recalled spa pumps between May 2021 and May 2024. Harper is suing for violations of warranty and product quality laws, and is seeking certification of the class action, damages, fees, costs and a jury trial, as well as a safe solution for recalling all the defective spa pumps.
