Sleep Number class action lawsuit overview: 

  • Who: Plaintiff June Evans filed a class action lawsuit against Sleep Number Corporation. 
  • Why:  Evans alleges Sleep Number used false reference prices on for-sale mattresses on its website and at its brick-and-mortar stores, in order to make consumers believe they were getting a bargain. 
  • Where: The Sleep Number false reference prices class action lawsuit was filed in California federal court. 

A new class action lawsuit alleges that Sleep Number used deceptive sales tactics to intentionally mislead consumers about the quality and value of the mattresses it sells on its website and at its brick-and-mortar stores. 

Plaintiff June Evans’ class action lawsuit claims Sleep Number displayed original prices on its for-sale mattresses that were higher than what the company frequently sold the mattresses at for periods of 90-days or more. 

Evans argues Sleep Number uses the so-called false reference prices on its for-sale mattresses in order to give consumers “the appearance of a bargain.” 

“Defendant’s advertised false reference prices and advertised false discounts were material misrepresentations and made for the purpose of inducing consumers like Plaintiff to make their purchase,” the Sleep Number class action says. 

Evans wants to represent a California class of consumers who purchased products from Sleep Number that were displayed as at a discount from a false reference price during the applicable statute of limitations period. 

Sleep Number false reference prices ‘not offered in good faith,’ class action claims

Evans argues that, while Sleep Number’s online store now reflects some or all of its products as advertised at full price, the company used deceptive pricing practices from August 2023 — and likely earlier — until around September 2024. 

“In short, Defendant’s sales tactics are not offered in good faith and are made for the sole purpose of deceiving and inducing consumers into purchasing products they otherwise would not have purchased,” the Sleep Number class action says. 

Evans claims Sleep Number is guilty of fraud and unjust enrichment and violating California’s Unfair Competition Law, False Advertising Law and Consumers Legal Remedies Act

The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of monetary, treble and punitive damages for herself and all class members. 

A pair of consumers filed similar class action lawsuits against Brooklyn Bedding LLC and Emma Mattress Inc., respectively, over claims the companies used inflated regular prices to make their on-sale products appear to be at a greater discount than they actually were.

    I purchased a Sleep Number on Nov. 24, 2025 at Fairview Heights store in Illinois. I was told I could get a free trial of 100 days to try sleep number bed. The first night the bed would not elevate the head of the bed. After having major back surgery on August 08, 2025 I was looking for a bed that would be comfortable r/t having 2 disk removed. Bilateral SI joint repair, and a cyst from my spine. The salesman told me it was absolutely make my back feel better. The second night, the controls didn’t change positions on the air mattress. I had very restless night, and could barely get out of bed. I was fully recovered from my back surgery and this mattress and base made it terrible to sleep. The third or fourth night, the air went completely out of the air mattress, and I was in horrible pain. I called and spoke with specialist and said I couldn’t take it anymore. She told me that I had to pay $2400.00 for the trial period, and they would not take base back. The sales handed me an Ipad that I could barely read, and said sign. I trusted SN, and thought I trusted him. He also told me the mattress pad was free. I had a charge of nearly $100.00 charge for the mattress pad, that I said I didn’t want. Now they have added so many different charges taking the $2500.00 down payment I paid. I have told them to come get the bed. One specialist told me I was not getting my money back, that she wasn’t givin it back. I have contacted the Attorney General of Minnesota. The better business bureau, and Sleep Number multiple times. SN claims to be number one rated, and with BBB ratings are 27, last time I looked. They turned the app. off to the bed, I didn’t get a remote to control the bed, and they won’t get it out of my house. This is the most dishonest company I have ever dealt with. I am a Senior Citizen, and this is elder abuse. They are charging different people different charges as reported on SN disgruntled customer link. I want in the Class Action Lawsuit.

    purchased november 2023 nothing but problems and no waranty as advertized

    This happened to my husband and me, also. Our bed is three years old and the repair would cost us over $600. The magnets which hold the mattress in place detached. I honestly think this is a manufacturer malfunction. When I raised the head of the bed in an upright position, the magnet detached.
