HP All-in-One Printers class action lawsuit overview:

  • Who: Two customers filed a class action lawsuit against HP, Inc. 
  • Why: The consumers claim HP fails to disclose a design flaw in its All-in-One Printers that prevents users from scanning or faxing without sufficient ink.
  • Where: The class action lawsuit was filed in California federal court.

Two owners of HP All-in-One Printers filed a class action lawsuit against the tech company for misrepresenting the functionality of the printers, which allegedly cannot scan or fax when ink is low or empty. 

This design flaw pushes owners of All-in-One Printers to purchase ink cartridges more than is strictly necessary, say Gary Freund and Wayne McMath, who filed the class action lawsuit against HP, Inc., also known as HP Computing and Printing Inc. Freund owns an HP Envy 6455e All-in-One Wireless Color Printer, and McMath purchased an HP Deskjet 2655 All-in-One Compact Printer, both of which allegedly experience the so-called design flaw. 

HP class action claims company forces consumers to purchase ‘incredibly overpriced ink cartridges in perpetuity’ 

By making printer owners repeatedly buy printer ink, which “can exceed $80 an ounce,” HP stands to make billions of dollars in ink sales alone, according to the HP class action. 

“The not-so-hidden secret in the retail printer industry is that manufacturers like HP are very willing to lose money on the sale of printers in order to force consumers to purchase incredibly overpriced ink cartridges in perpetuity,” the complaint says. 

To that end, the lawsuit says HP claims in its marketing, advertising, packaging and website representations, that its All-in-One Printers can print, copy, scan and, in some cases, fax documents at any time. However, it supposedly fails to disclose that the scanning and faxing functions of the printer, which do not require ink, do not work if the ink cartridges are low or empty. 

Freund and McMath seek monetary damages and injunctive relief requiring HP to cease its allegedly misleading advertising and inform consumers of its alleged errors.

Freund and McMath seek to represent a nationwide class that includes everyone who bought an HP All-in-One Printer for personal/household use at any time within the applicable statute of limitations, as well as California and Minnesota subclasses.

    I have tried to cancel my HP Instant Ink subscription multiple times now. I am still being charged an outrageous amount of money every month and I am about to take a hammer to it. This is outright theft!

    I didn’t know that hp will remotely disable and prevents us from printing once we cancel hp instant Inc subscription. Which I think is a scam cos those inks were paid for so why would they not allow me to print?? So now all the hp ink cartridges that I paid for while I was enrolled in hp instant ink. Doesn’t work. I p had blocked my printer from printing using ink cartridges I had laid for.

    I also have an HP all in one and they make me pay a subscription to print anything otherwise the stupid thing doesn’t work and if I go over the page allotment for the month they add a $1 per page to my bill. This is insane.

    I have an HP8025e, if I am not enrolled in instaink, my printer will not print. So I am forced to to be enrolled.

    I own 3 HP 8610 Printer Scanner and Fax that won’t work with aftermarket ink cartridges installed after HP software update

    THE PRINTERS RUN OUT OF INK FAST. GENERIC COMPATABLE CARTRIDGES DON’T WORK ANYMORE, BECAUSE HP WILL NOT LET US DOWNLOAD OLDER FIRMWARE. HP INK IS TWICE AS EXPENSIVE AS GENERIC,AND REFILLING HP CARTRADGES NO LONGER WORKS. I NEVER WOULD HAVE BOUGHT ANOTHER HP PRINTER.

    I started having trouble with ink on my Photosmart 6510. Daughter using the printer to print things out for granddaughter. I decided to buy after market ink to try save money. I got notice that my ink not HP. I have had Wi-Fi connections with that printer since new. Now with the ink it will not work with HP ink. I was told to sign up for instant ink to save me money. I said my printer not working. They said buy ink and they will fix it. I was able to connect the second HP printer after signing up. Could not get the first printer working so canceled instant ink. I told them that I am done with HP. I said will buy another brand. I did just that yesterday. I said when the other HP runs out of ink going to junk that one as well. I have genuine HP in in it, But does not print like it used to. Not only ink problem. Also the printer settings do not keep your settings. Menu screwy. Shows Monochrome instead of black. Also it goes to landscape. Will not stay on Portrait.
