HP All-in-One Printers class action lawsuit overview:

  • Who: Two customers filed a class action lawsuit against HP, Inc. 
  • Why: The consumers claim HP fails to disclose a design flaw in its All-in-One Printers that prevents users from scanning or faxing without sufficient ink.
  • Where: The class action lawsuit was filed in California federal court.

Two owners of HP All-in-One Printers filed a class action lawsuit against the tech company for misrepresenting the functionality of the printers, which allegedly cannot scan or fax when ink is low or empty. 

This design flaw pushes owners of All-in-One Printers to purchase ink cartridges more than is strictly necessary, say Gary Freund and Wayne McMath, who filed the class action lawsuit against HP, Inc., also known as HP Computing and Printing Inc. Freund owns an HP Envy 6455e All-in-One Wireless Color Printer, and McMath purchased an HP Deskjet 2655 All-in-One Compact Printer, both of which allegedly experience the so-called design flaw. 

HP class action claims company forces consumers to purchase ‘incredibly overpriced ink cartridges in perpetuity’ 

By making printer owners repeatedly buy printer ink, which “can exceed $80 an ounce,” HP stands to make billions of dollars in ink sales alone, according to the HP class action. 

“The not-so-hidden secret in the retail printer industry is that manufacturers like HP are very willing to lose money on the sale of printers in order to force consumers to purchase incredibly overpriced ink cartridges in perpetuity,” the complaint says. 

To that end, the lawsuit says HP claims in its marketing, advertising, packaging and website representations, that its All-in-One Printers can print, copy, scan and, in some cases, fax documents at any time. However, it supposedly fails to disclose that the scanning and faxing functions of the printer, which do not require ink, do not work if the ink cartridges are low or empty. 

Freund and McMath seek monetary damages and injunctive relief requiring HP to cease its allegedly misleading advertising and inform consumers of its alleged errors.

Freund and McMath seek to represent a nationwide class that includes everyone who bought an HP All-in-One Printer for personal/household use at any time within the applicable statute of limitations, as well as California and Minnesota subclasses.

    Desk jet all in one 2700 hp instant ink is a scam they billed me 5 x when I was on a free trial I didn’t pay and they suspended my account making me lose out on 4 months of my trial had to pay to reinstate service then they would not reimburse my money and give me the months I lost out on and if u cancel the subscription ur printer is just a paper weight

    I bought a hp printer and couldn’t understand why they sent ink before I needed it, why the cartridges I bought off Amazon after we had to cancel instant ink wouldn’t work, and when I tried to get it going again after deleting it from my devices, when I would try to enter my pin number to establish another instant ink acct, it said pin was incorrect. Instant ink would bill us for ink when it was low, overdrawing bank account resulting in bank fees, and eventually had to buy another printer. When I purchased it with my stimulus in 2021, I had no idea it worked that way. I want to join as well.

    I too have been completely misled by HP. Their instant ink subscription service led me to believe that I only have to use the amount of ink I actually go through (I don’t print that often), but when it kept sending me new cartridges despite the fact that I hadn’t used up the last ones, I canceled the subscription. Next time I go to print, the printer can no longer connect to my computer? Printing is disabled?? That doesn’t seem legal. I know you need to be an active subscriber to keep getting the ink but…I wish they would let you control how often you pay so you’re not overpaying for ink you don’t use. And now I can’t even use the printer because I’m not actively paying for the service??? That’s crazy. I also think it’s suspicious that for the HP Envy you’re supposed to keep your printer on and connected to wifi at ALL times? I don’t want to waste electricity like that. Also, there have to be safety issues with it being connected to my wifi and monitoring what I do. All around completely suspicious business practices. I literally haven’t used my printer in years even though it’s like new because of this issue. I go to the copy store when I need to print something these days. WHAT A WASTE.

    Wf7720 same crap! Can’t do anything if 1 ink cartridge is low. Sometimes put new cartridge in, and it says can’t recognize! They need to be sued!

    How and when can we join this? My HP envy has been nothing but a headache it’s the worst all in one I’ve ever owned. Slow, confusing, makes a high pitched noise that will make you go crazy, and worst of all I run out of ink once a month because new cartridges only print like 60 pages. I feel so ripped off and HP customer service has been zero help

    I have the HP Desk inkjet 3755 and I am so upset because I just bought this and had no idea! I was starting to install/set it up and stopped everything before I subscribed to anything! I cant return it now, so my money just went down the drain basically.. This is such a scheme, Im pissed and Id like reimbursement. Id appreciate it if I could be included in this as well please?
