HP All-in-One Printers class action lawsuit overview:
- Who: Two customers filed a class action lawsuit against HP, Inc.ย
- Why: The consumers claim HP fails to disclose a design flaw in its All-in-One Printers that prevents users from scanning or faxing without sufficient ink.
- Where: The class action lawsuit was filed in California federal court.
Two owners of HP All-in-One Printers filed a class action lawsuit against the tech company for misrepresenting the functionality of the printers, which allegedly cannot scan or fax when ink is low or empty.ย
This design flaw pushes owners of All-in-One Printers to purchase ink cartridges more than is strictly necessary, say Gary Freund and Wayne McMath, who filed the class action lawsuit against HP, Inc., also known as HP Computing and Printing Inc. Freund owns an HP Envy 6455e All-in-One Wireless Color Printer, and McMath purchased an HP Deskjet 2655 All-in-One Compact Printer, both of which allegedly experience the so-called design flaw.ย
HP class action claims company forces consumers to purchase โincredibly overpriced ink cartridges in perpetuityโย
By making printer owners repeatedly buy printer ink, which โcan exceed $80 an ounce,โ HP stands to make billions of dollars in ink sales alone, according to the HP class action.ย
โThe not-so-hidden secret in the retail printer industry is that manufacturers like HP are very willing to lose money on the sale of printers in order to force consumers to purchase incredibly overpriced ink cartridges in perpetuity,โ the complaint says.ย
To that end, the lawsuit says HP claims in its marketing, advertising, packaging and website representations, that its All-in-One Printers can print, copy, scan and, in some cases, fax documents at any time. However, it supposedly fails to disclose that the scanning and faxing functions of the printer, which do not require ink, do not work if the ink cartridges are low or empty.ย
Freund and McMath seek monetary damages and injunctive relief requiring HP to cease its allegedly misleading advertising and inform consumers of its alleged errors.
Freund and McMath seek to represent a nationwide class that includes everyone who bought an HP All-in-One Printer for personal/household use at any time within the applicable statute of limitations, as well as California and Minnesota subclasses.ย

Please add me I have the HP Deskjet 4100 and the Envy 6000 both are brand new but wonโt work since they tricked me with the 6 months free ink once I cancelled neither printers would fax or scan. Even with the instant ink it wouldnโt connect properly which caused a lot of aggravation!
I just bought the Epson eco tank and hopefully this one will do the job the other printers couldnโt.
Same here. office jet pro 8035 cartridges have been blocked because they are not HP.
Iโve got a hp 8020 inkjet all in one and they will not let it print. Iโve bought a couple in the last year. I want in.
I have several HP printers. I originally enrolled three of them into HPโs Instant Ink program. After reviewing their billing against the ink cartridges I was receiving, I decided to cancel each account. To date, even though each account has been successfuly canceled, I continue to receive notices that my printers are not in contact with HP Instant Ink servers. When I attempt to replace the program cartridges with store bought units, I receive notices that โnon HP ink cartridge problemโ or โPrinter failure.โ There is nothing mechanically wrong with any of my printers. While HP claims the cartridges are protected, I cannot disable that feature. HP is effectively holding my printer hostage because I will not use HP manufactured cartridges. This is an outrage! The printer belongs to me and I should be able to use any compatible ink cartridge.
Itโs a complete scam. Once your black ink is low, you arenโt able to use any other functions. They try to wheel you in with the gimmick of 6 months of free ink, but t they have to have 24 hour access to your device and the 6 months turns to 3 months. Worse purchase of my life and invasion of privacy.
I donโt see my name. I thought I made a comment regarding this same issue some time ago. I was told that the highlighted text would print out in a grayish color when you didnโt have the colored cartridge attached ; but this is not true. You need both the black and colored cartridges to print out highlighted text.
We bought a HP All n One printer. It stopped when it ran out of black ink. We will never buy another HP of any kind. Having to join a subscription clun and buy ink you donโt need is BULL. Sign me up for lawsuit
Totally agree โ worst thing I ever bought- Hewlett-Packard is a blatant fraudulent company. Never buy anything from them
Iโm in the UK and just recently bought a 4100e and didnโt sign up to HP+. Iโm infuriated by this and would never have bought this model, had I known about these issues, including the inability to use remanufactured cartridges. GRrrr!
I enrolled in HP instant ink program when my original cartridge was low I received box with new ink cartridges and a empty bag to ship my original cartridges in for Recycle I keep my account updated until I notice I was being billed every month although I didnโt need ink I called hp they give me some extra story on my I should keep them and if I was to end my cartridges wasnโt going to be able used any more after the billing cycle I canceled subscription and now my printer is completely malfunctioning
Please add me to the case! Iโm a business owner and got tied up in other things and wasnโt able to return the printer within my warranty, and it didnโt work since day oneโฆ Absolute fraud for them to send a fake product that doesnโt work and then not let me return it.
I want in! I wish I had bought a different printer!
