HP All-in-One Printers class action lawsuit overview:
- Who: Two customers filed a class action lawsuit against HP, Inc.
- Why: The consumers claim HP fails to disclose a design flaw in its All-in-One Printers that prevents users from scanning or faxing without sufficient ink.
- Where: The class action lawsuit was filed in California federal court.
Two owners of HP All-in-One Printers filed a class action lawsuit against the tech company for misrepresenting the functionality of the printers, which allegedly cannot scan or fax when ink is low or empty.
This design flaw pushes owners of All-in-One Printers to purchase ink cartridges more than is strictly necessary, say Gary Freund and Wayne McMath, who filed the class action lawsuit against HP, Inc., also known as HP Computing and Printing Inc. Freund owns an HP Envy 6455e All-in-One Wireless Color Printer, and McMath purchased an HP Deskjet 2655 All-in-One Compact Printer, both of which allegedly experience the so-called design flaw.
HP class action claims company forces consumers to purchase ‘incredibly overpriced ink cartridges in perpetuity’
By making printer owners repeatedly buy printer ink, which “can exceed $80 an ounce,” HP stands to make billions of dollars in ink sales alone, according to the HP class action.
“The not-so-hidden secret in the retail printer industry is that manufacturers like HP are very willing to lose money on the sale of printers in order to force consumers to purchase incredibly overpriced ink cartridges in perpetuity,” the complaint says.
To that end, the lawsuit says HP claims in its marketing, advertising, packaging and website representations, that its All-in-One Printers can print, copy, scan and, in some cases, fax documents at any time. However, it supposedly fails to disclose that the scanning and faxing functions of the printer, which do not require ink, do not work if the ink cartridges are low or empty.
Freund and McMath seek monetary damages and injunctive relief requiring HP to cease its allegedly misleading advertising and inform consumers of its alleged errors.
Freund and McMath seek to represent a nationwide class that includes everyone who bought an HP All-in-One Printer for personal/household use at any time within the applicable statute of limitations, as well as California and Minnesota subclasses.

We have an HP Envy 6455e All-in-One Wireless printer and it’s awful. We have to buy ink like crazy and when it’s out it still want let you scan anything. It’s bs.
I would like to be added and find out how to submit a claim. We have an hp printer and do the ridiculous insta ink over charge thing too…crazy we can buy our own ink cheaper and they do it based on per page they charge you…
Add me please!!! I have an HP Envy 5055 All-in-One printer and problems it definitely has. Especially, with the Always stuck on OFFLINE feature and being overcharged with HP Ink. Yes, please add me.
I want in on this class action. I bought an HP all in one 3755 the only thing it ever prints is pages upon pages of information on printer status and connections. Im so frustrated to tears. I needed to use this printer to make special christmas presents before I die but no I wasted what little money I had on junk printer that won’t work at all.
Add me as well. Same issue as many of the others. Forcing me to buy their ink. HP, a joke of a company. They need to go down!
This company is one hell of a joke I cannot believe more is not being done! I get on the phone and they call me some other woman’s name and then referred to me as a man although irreverent both on the phone and online rather be the app or website malfunctions to the fullest extent and has no purpose in serving customers ! False advertisement to be shy about the scam they are pulling And you were punished if you do not purchase Inc. in a manner that they can rip you off and charge you any time of the day! Multiple charges yet no ink! This is no way to run a company They won’t even give me an address to send the printer back just transfer to the next employee who is supposed to be in another department yet you can clearly hear both employees whispering meanwhile im still waiting for the music on the phone line to begin??? Yet I am suppose to trust this company?? I’ve never been more scammed in front of my face in my resistance! I know what a printer is capable of doing and what I showed my in-laws made them never want to touch another printer again they said it would be easier to pick up their pictures from a local Walgreens outside of 10 mile radius how pathetic I ruined their outlook on the idea of easy at home printing because of a companies lies! Sign me up!
Please add me to the lawsuit I’m going through the same issues with HP after they charge me for months for the wrong printer and sent me the wrong ink and then they canceled my subscription at the last minute prior to my subscription being canceled they had sent me new cartilage 4 months in advance now not only can I use the rest of the ink that I had left over but I cannot use the ink that I already paid for this is a scam and I don’t think it is right so please ask me to your list customer service was very rude with me I never received my 6-month trial for my new printer thank you I feel much better knowing that something is being done about this issue and the other issues.
Paid several months for the instaink which I didn’t use most months they sent me ink till a certain time frame then no ink and I wasn’t printing either but HP kept charging my credit card every month. I finally cancelled my subscription and went to use cartridges I had left over and HP blocked me from using already paid for merchandise.
This printer overprints and of course hp charges you after 100 pages. They reprinted over 30 pages in one day with no resolving the issue. They overcharge and force customers to use services that are far from being intergrated into our everyday use. The apps it recommends 3 for 1 printer, plus signing into it all, and the constant product waste, product cost, and lack of interaction with customers to resolve all issues. This printer is too annoying to use, too expensive, and too time consuming. All the things customers hate!
I quit Instant Ink… after they signed me up without asking. They then resigned me up and are preventing me from printing with the cartridges I manually purchased and installed. It’s really elder abuse!!! Totally crooked.
